TORONTO (CP) - Notorious Holocaust denier Ernst Zundel has abandoned his long fight to stay in Canada and is slated to be deported to Germany as early as Tuesday, his lawyer said Friday.

Zundel faces immediate arrest and prosecution in Germany for spreading hate.

"He won't be asking for a stay," his lawyer, Peter Lindsay told The Canadian Press.

"This is an unfair process. Everyone has turned their backs on him."

Lindsay said Zundel had given Canadian courts repeated chances to remedy the "unfairness that he has been subjected to and they haven't."

Lindsay said Immigration authorities were not prepared to wait to see whether the Supreme Court of Canada would hear his allegation of judicial bias, the lawyer said.

An Immigration spokesman said they planned to deport him as soon as possible.

Apparently this is inaccurate. Ingrid Rimland states on the Zündelsite (morning of 26 February 2005):

I talked to Ernst at noon. He said he had no intention of NOT using every available means to wait for the Security Certificate evaluation in Parliament and the case by this Arab - the name escapes me now - who is challenging the Certificate on constitutional grounds in the Supreme Court. [Ernst] said the case was filed on the 15th.

I had been scared last night by some Jew who was crowing that Ernst would be deported any minute, that his deportation was imminent - but when I talked to Ernst, he laughed and said it would not happen that way.

He thought it might be weeks or even months until the deportation could be effected. He was actually in high spirits, as if he had something up his sleeve.

Statement from Ernst Zundel's Lawyers

This statement concerns the pending deportation of 65 year old Ernst Zundel, who lived in Canada from 1958 to 2000, who has no criminal record in Canada and who faces no criminal charges in Canada.

Mr. Zundel has been in solitary confinement for 2 years and is about to be deported after a largely secret proceeding against him. The Crown and the presiding judge met secretly throughout his case, in the absence of Mr. Zundel and his lawyers. The Crown repeatedly presented evidence and made arguments to the judge in a Star Chamber type proceeding.

At the public proceeding, Mr. Zundel was told literally hundreds of times, when he asked for specific evidence of the case against him, that there was “nothing in the unclassified materials” . He was repeatedly blocked from asking questions of witnesses on the basis of “national security”.

The presiding judge made repeated serious errors, forgot submissions and repeatedly misstated the appropriate legal test about what evidence should be kept secret. The same judge then evaluated the secret evidence.

Mr. Zundel complained of reasonable apprehension of bias by that judge. The same judge rejected Mr. Zundel’s argument and later ordered him deported.

The Federal Court of Appeal rejected his appeal regarding bias. It appears that the Crown will not wait to see whether the Supreme Court of Canada will hear the further appeal Mr. Zundel has already filed on the bias issue. The Crown will deport him NOW.

The Supreme Court of Canada has been asked, in Mr. Adil Charkaoui’s case, to consider the constitutionality of the law which allows secret evidence by which Mr. Zundel is deported. The Crown will not wait until the Supreme Court decides whether to hear that appeal. If the law is ultimately ruled to be unconstitutional, Mr. Zundel will likely hear about it from a German jail cell.

Probably no one cares because Mr. Ernst Zundel is notorious and reviled. The powerful and the popular do not need to rely on the fairness of our legal system. The marginalized and the reviled do. Our system has failed Mr. Zundel. We should care. But we fear most of us don’t give a damn.

Mr. Zundel will not initiate any further court proceedings in Canada. His repeated request that Canadian courts recognize his rights to basic fairness and justice have been unanswered. He will not beg for those rights.

Mr. Zundel has gone through the entire security certificate process, unfair though it was, to a conclusion. He has no right to appeal or to judicial review. He has gone to every available level of court in Canada.

For 42 years, he has vigorously defended his freedom of expression within the Canadian justice system. All legal avenues have now been exhausted, as has his faith in the Canadian justice system and this security certificate system, which has been characterized by a Canadian journalist, after witnessing part of Mr. Zundel’s proceeding, as a “frightening charade of justice”.

BTW it seems that harkening to the voice of the Jew is a White problem. The other races (Chinese,etc.) seem to instinctively know the Jews are lying degenerates. Many seem to think our problem is exposing the Jew. I wish it were that simple. The Arabs for example know the Jews are degenerate scum, yet that does not stop them from pouring into White lands. I have heard from many Euros that the Muslims say that soon Europe will be their's. Pray tell how will Holohoax Revisionism stop that ?

Holohoax propaganda has everything to do with the current compulsion toward racial tolerance in Europe. It is all based on a reaction to the Jewish caricature of a nazi as somebody who wants to put everybody who isn't blond and blue-eyed (especially poor innocent Jews) into a gas-chamber or "gas oven." All you have to do to realize this, is listen to people talk. On top of that, as Kofi Annan noted in September 2001, the Holohoax is used by the Jews as an excuse for everything that they do. I am really astounded that there are intelligent people who think that bringing out the facts about this matter is not important.

I don't claim that revisionism is a panacaea (cure-all). It is however a good start in breaking the grip that Jewish power has on the minds of otherwise rational people. Once you've done that, the possibility of discussing other ideas opens up.

There is at least one good book about Andersonville Prison. The German-Swiss commandant of that Confederate prison was subjected to the same kind of slander that was later faced by the staff of German concentration camps in 1945. Atrocity-propaganda like this has the effect of allowing the victor to seem justified in whatever cruel measures he may chose to take against the people allegedly responsible for the atrocities.

Rechtsextremist Zündel offenbar aus Kanada abgeschoben

Frankfurt/Main (AP) Der deutsche Rechtsextremist Ernst Zündel ist offenbar aus Kanada abgeschoben worden. Wie der «Tagesspiegel» (Mittwochausgabe) unter Berufung auf Sicherheitskreise berichtete, wurde Zündel in eine Sondermaschine gesetzt, die noch am Dienstagabend in Frankfurt am Main erwartet wurde. Bei seiner Ankunft werde er auf dem Flughafen festgenommen. Nach Angaben der Staatsanwaltschaft Mannheim liegt seit 2003 ein Haftbefehl des Amtsgerichts Mannheim wegen des Verdachts der Volksverhetzung gegen Zündel vor.

Eine Sprecherin der Anklagebehörde konnte den Zeitungsbericht auf AP-Anfrage nicht bestätigen. «Weil wir keine Auslieferung beantragt haben, liegt die Sache in kanadischer Hand», sagte die Sprecherin. Grundlage für den Haftbefehl ist demnach Zündels Website, wo unter anderem der Massenmord an den Juden durch das NS-Regime in Deutschland geleugnet wird.

Der heute 65-jährige Zündel lebt seit 1958 in Kanada und ist vor allem als Verleger rechtsextremistischer Schriften bekannt geworden. Unter anderem verschickt er den unregelmäßig erscheinenden «Germania-Rundbrief», der antisemitische Thesen enthält. Er hatte sich mehrfach vergeblich um die Einbürgerung in Kanada bemüht. 2003 hatte er versucht, die amerikanische Staatsbürgerschaft zu erhalten, war aber von den US-Behörden nach Kanada abgeschoben worden.

Seitdem war er auf Grundlage eines neuen kanadischen Anti-Terror-Gesetzes in Toronto inhaftiert gewesen. Die Behörden prüften, ob er ein Sicherheitsrisiko für die kanadische Gesellschaft darstelle. Vergangene Woche hatte ein Bundesgericht in Ottawa Zündels Auslieferung angeordnet. Sein Anwalt Peter Lindsay hatte daraufhin mitgeteilt, dass sein Mandant keine Rechtsmittel einlegen werde und voraussichtlich am Dienstag nach Deutschland gebracht werde.

Der deutsche Rechtsextremist Ernst Zündel ist nach seiner Abschiebung aus Kanada in Mannheim inhaftiert worden. Der zuständige Richter hat den Haftbefehl gegen Zündel aus dem Jahr 2003 heute vollzogen. Zündel sollte daraufhin in die Justizvollzugsanstalt Mannheim eingeliefert werden. To protest the detention of Ernst Zundel in Germany, some 40-50 activists of the “Rhein-Neckar National Resistance Action Center” rallied on Wednesday, March 2, in the pedestrian shopping zone in central Mannheim. They distributed leaflets demanding freedom for Zundel and all other political prisoners, and the abolition of the laws that ban “Holocaust denial” and restrict free speech. Our German colleagues have written to Ernst Zündel to find out what his wishes are regarding visitors (too many at once is not useful and Ernst’s wishes will be the deciding factor). They are also planning – again with Ernst’s agreement – to choose someone to coordinate visits etc. The person proposed is Günter Deckert who lives in the region and also has gained his own experiences with the German Justice and Prison authorities.

Ich habe Ernst Zündel bereits vorgestern angeschrieben und ihn gebeten, in Erfahrung zu bringen, welche behördlichen Voraussetzungen für einen Besuch zu erfüllen sind. Wie ACE Altenburg richtig dargestellt hat, ist das Procedere von Bundesland zu Bundesland; manchmal gibt es sogar innerhalb EIN UND DES SELBEN Bundeslandes Unterschiede; und außerdem gibt es vielfach einen Unterschied zwischen Strafhaft und Untersuchungshaft.

Die Modalitäten werden geklärt und öffentlich gemacht. Die Haftadresse ist ja sowieso öffentlich, so daß jeder, der will (und des es egal ist, ob er bei einer Behörde oder einem Gericht registriert wird....) auch direkt an ihn schreiben kann.

Darüber hinaus ist angedacht, daß jemand zentral die Fragen der Betreuung und Versorgung (und mithin auch die Koordination der Besuche) übernehmen könnte; vorausgesetzt natürlich, daß Ernst damit einverstanden ist. Diese Entscheidung - ob oder wer - ist noch nicht getroffen. Als Kandidat ist Günter Deckert im Gespräch, der den Vorteil der räumlichen Nähe zu Mannheim sowie eigener Hafterfahrung und auch Erfahrung im Umgang mit Justiz und Behörden hat und darüber hinaus mit vielen inländischen und ausländischen Protagonisten des Geschichtsrevisionismus wegen seiner eigenen revisionistischen Arbeit vertraut ist. Aber, wie gesagt, eine Entscheidung ist in der Kürze der bisher verstrichenen Zeit noch nicht gefallen.

Zudem bin ich sicher, daß Ernst Zündel selbst sich bald mit einem Rundschreiben aus der Zelle melden wird. Da das durch eine möglicherweise doppelte Zensur läuft (Gericht und ggfs. auch Anstalt), kann es zu Zeitverzögerungen bei der Post kommen, aber ich vermute, daß es wohl irgendwann im Laufe der nächsten Woche ein erstes zur allgemeinen Verbreitung und Kenntnisnahme bestimmtes Statement von ihm geben wird. Ernst Zündel hat in Kanada sowohl Organisations- als auch Medienarbeit betrieben und ist in diesen Dingen sehr erfahren.
