Conyers, who initially opposed the 2007 deal, switched her position as the council voted 5-4 to let Synagro dispose of wastewater sludge.A source familiar with the inquiry said federal investigators also are talking to Conyers about investments by Detroit's public pension funds. Conyers is a former trustee for the city's general retirement fund.
Several people familiar with the talks spoke with the Free Press but asked not to be identified because of the sensitivity of ongoing negotiations.
Conyers declined to comment.
One source said the prosecutors offered her ex-aide, Sam Riddle, a deal if he would plead guilty to bribery and tax evasion.
Riddle said: "I won't discuss the elements of any offers ... but a bad deal is no deal."

Principal, Assistant Principal Arrested In Cheating Investigation

ATLANTA -- Police say a suburban Atlanta principal and his assistant principal have been arrested in connection with an investigation into whether student test scores were altered to improve school performance.



Former Atherton Elementary principal James Berry was arrested at home Friday. Assistant principal Doretha Alexander turned herself in to police Thursday night and was later released on bond.

They face charges of altering public documents.

The arrests follow an audit last week that found a high number of eraser marks on tests from four Georgia schools, including Atherton. State officials have said the higher scores helped the schools meet federal standards.

Berry resigned last week, while Alexander was reassigned by district officials. Neither has returned multiple calls seeking comment.

The Governor's Office of Student Achievements preliminary audit results revealed that someone deliberately changed students' answers on the 5th grade CRCT math re-test.

DeKalb County school officials issued a statement on the findings, saying that the school system’s initial “internal investigation concluded that there was no evidence of irregularities” but they welcomed an investigation by the state. That’s when the Governor’s Office of Student Achievement found someone changed the Atherton students’ answers on the math re-test.

Last week, DeKalb County school superintendent, Dr. Crawford Lewis, said, “The evidence presented was both compelling and troubling to me as superintendent of the DeKalb County School System. I assure you I am moving with great speed to address this matter internally.”

The state said the scores improved significantly by the changes. At Atherton, the state found on average, answers were altered 21 times per student, the majority of the changes making them correct.

Other metro Atlanta schools being investigated are Deerwood Academy in Atlanta, and Parklane Elementary in Fulton County.

State Prosecutor Robert A. Rohrbaugh had sought to subpoena two current city employees and one former employee to provide records and testimony about gift cards under their control. But Rohrbaugh's office withdrew the subpoenas late Wednesday, shortly after Dixon's attorneys filed a motion seeking to have the subpoenas quashed.

"The withdrawal of these subpoenas was an obvious acknowledgment that an improper use was being made of the grand jury and that the subpoenas should not have been issued in the first place," said Arnold M. Weiner, an attorney for Dixon. Rohrbaugh declined to comment.

Dixon faces trial in September on seven criminal counts including theft. She is accused of stealing gift cards intended for needy families.

City Solicitor George Nilson confirmed Thursday that subpoenas for Carolyn Blakeney, an assistant deputy mayor, and Zoe Michal, Dixon's scheduling director, had been withdrawn.

The attorney for Anne Lanskey, the former city employee, also said Thursday that her subpoena had been withdrawn.

Attorneys for Dixon had argued that the prosecution was abusing the grand jury process by hauling witnesses before a grand jury to collect evidence before Dixon's trial.

Weiner said in his motion that prosecutors may not use grand juries "for the sole and primary purpose of gathering evidence for use in pending litigation, or to prepare for trial."

David Gray, an assistant professor of law at the University of Maryland, described the withdrawal of the subpoenas as "a solid victory" for Dixon's defense.

But the prosecutors' attempt to subpoena witnesses does not necessarily mean their case is lacking and it may have been just an unintentional violation of procedural rules, Gray said. Prosecutors typically continue gathering evidence after securing an indictment but cannot use grand juries to do so, he said.

Dixon, a Democrat, was initially charged in a 12-count indictment, but five counts were thrown out after a judge ruled that prosecutors improperly used legislative acts as evidence against her. The dismissed charges included accusations that Dixon committed perjury by failing to disclose lavish gifts from a developer boyfriend.

The remaining charges have to do with gift cards to stores including Best Buy and Target. According to prosecutors, Dixon asked developers to donate the cards to needy families, then used them for her personal Christmas shopping. The mayor could be tossed out of office if convicted on any of the seven remaining counts.

Records indicate that the payments and cancellations of the contract coincide with their makeups and breakups. So far, Watts-Brighthaupt has been paid $15,000, and at Barry's request, the secretary of the council has approved an additional payment of $5,000.

"Everybody's better off walking away from [the stalking charge], but he has a raft of other challenges he has to deal with," said Frederick D. Cooke Jr., Barry's attorney, referring to the contract.

D.C. Attorney General Peter Nickles said yesterday that he will investigate if the council doesn't. "My strong preference would be to have the council look into it," he said. "After all, it's money allocated to the council. If the council chooses not to look into it, then I certainly would."

Barry's former campaign manager, Joe Louis Ruffin Jr., also questioned yesterday why Watts-Brighthaupt was paid $500 in campaign funds a week after she received the city contract

According to U.S. Park Police, Barry, 73, was arrested and charged after Watts-Brighthaupt, 40, flagged down an officer in Anacostia Park and complained that Barry was "bothering" her. It was a murky incident, made more complicated when it was revealed that the two had planned a day trip to Rehoboth Beach, Del., but canceled it and returned to the District after an argument.

She's been arrested and is now accused of misusing city funds.
Mayor Martha Andrus turned herself in to authorities Tuesday.
She was booked and charged with unauthorized use of a movable and malfeasance in office.
The 69-year-old mayor is accused of using city money to reimburse two former employees who had been arrested.
She allegedly reimbursed them for bond money.
Andrus will be arraigned in August.
For now, she's free on $5,000 bond.

Detroit -- The woman charged with monitoring the Detroit Police Department's adherence to a 2003 agreement with the U.S. Department of Justice has submitted her resignation because of her interactions with former Mayor Kwame Kilpatrick.
Sheryl L. Robinson Wood submitted her resignation to U.S. District Court Judge Julian Abele Cook Jr. Thursday evening. Detroit's Police Department has been under federal supervision for six years after a Justice Department investigation found instances of civil rights violations via police brutality, locking up homicide witnesses and keeping unsafe holding cells where prisoners died.
An agreement struck between the city and federal investigators called for sweeping changes, and Wood was put in place to ensure they took effect.

But in a court order finalizing the resignation, Cook wrote of Wood that "she had engaged in conduct which was totally inconsistent with the terms and conditions of the two consent judgments in this litigation."
Cook's order goes on to detail the nature of that conduct.
"It has now become readily apparent to the court that (Wood) had engaged in undisclosed communications, as well as meetings of a personal nature, with the former City of Detroit Mayor Kwame Kilpatrick during the term of the consent judgments, which included inappropriate discussions with him about this lawsuit."
Friday evening, Detroit Mayor Dave Bing's office issued a statement on Wood's resignation.
"The revelation about the court-appointed monitor is disappointing, and her resignation is appropriate," the statement reads. "As instructed by Judge Cook, we will work with the Justice Department in selecting a new monitor, and remain dedicated to fulfilling the requirements of the consent decrees."
Wood could not be reached for comment Friday evening. Cook's order calls for the immediate suspension of monitoring activities in the case.
William Goodman, an attorney who has sued the city over police misconduct, said he was shocked by the development.
"I have had, personally, some questions on why it was taking so long for the monitor to achieve compliance," said Goodman, who attended the last hearing called by Cook. "I am absolutely stunned.
"It's really very sad. What should have been a very enabling process ... has become a scandal and disgrace."
The city is spending about $10 million to pay a federal monitor over the life of the consent decrees.
Goodman said the city should demand the money be returned by Wood and the private company she works for, Kroll Associates, calling Wood's behavior "unethical and outrageous."
"They have obtained money to engage in an arms length process and gotten much closer than an arms length process and have benefited from it," Goodman said.
The City Council is expected to have a closed meeting Monday to discuss the consent decrees.
During a recent court hearing called by Cook, he harshly criticized the police department's performance in living up to the terms of its agreement.
"I have called this open session of the court because of my extreme displeasure with the progress that has been made," he said. Cook added that the department had me only 39 percent of its compliance goals.
At that time, Wood reported some progress made by the city, including: witnesses no longer being arrested without court approval, reductions in jailhouse deaths and improved officer training.

Former Councilwoman Monica Conyers, who pleaded guilty to taking bribes in exchange for her vote on the $1.2 billion sludge deal, is "petrified" about the prospects of prison says her lawyer, Steve Fishman. He also says that Sam Riddle, Conyers' former associate who is also the subject of federal bribery investigations, should stop shooting his mouth off in the press and cut a deal with prosecutors.

"Far be it for me to tell anybody what to do," Fishman says. "But if I got trapped in a burning house, I would probably try to find the hose rather than the box of matches."
Aldolph Mongo, political strategist and rabid Detroit booster, says the city is "out of control" and believes that Mayor David Bing was right to unceremoniously dump his chief of police last week.
"Right thing to do, wrong way to do it," Mongo says. "We've got a lot of dysfunctional people running around. Criminals have really staked out the city and are really running parts of the city."
As a special treat, Reeves, the former Motown star, sings tribute to the late Michael Jackson as Fishman accompanies her on keyboards.

Officials on Monday said they're exploring legal action after the U.S. Justice Department shared text messages with them showing a "personal relationship" between the former mayor and Sheryl Robinson Wood, who resigned last week as the monitor overseeing Detroit police reforms.

The messages between 2003 and 2005 indicate Wood and Kilpatrick met in Washington, D.C., and "several other cities" for meetings unrelated to a consent decree implemented to curb police abuses, said Saul Green, a city executive who oversees public safety. The city paid the monitor at least $10 million through 2006.

"They showed contacts between the monitor and the former mayor that were inappropriate and also an exchange of information related to the litigation," said Green, who declined to say whether the encounters were intimate.

"It was a personal relationship in which they met, in which they went to dinner."

U.S. Attorney Terry Berg said Monday that he couldn't say if the Justice Department would open an investigation into Wood. He declined to discuss the texts or how the department obtained them.

"This is a serious situation," Berg said.

Green also wouldn't say how the feds obtained the messages, but the development could underscore federal interest in Kilpatrick. He resigned last year and served jail time after text messages indicate he lied during a 2007 police whistle-blower trial about his affair with former chief of staff, Christine Beatty. More than 600,000 messages -- many of which have never been released -- were obtained by Wayne County prosecutors.

Since then, Kilpatrick and his father, Bernard Kilpatrick, have been linked to a federal corruption probe into pay-to-play accusations at City Hall.

City Council briefed

Green, the former U.S. attorney for the Eastern District of Michigan, briefed the City Council for about two hours Monday about the messages with the city's corporation counsel, Krystal A. Crittendon. Some members say they are considering legal action to recoup some of the money they have paid to the federal monitor since 2003.

"Every penny," said Councilwoman Barbara-Rose Collins, who missed the meeting with Green. "I think they should both go to jail for this."

She likened Kilpatrick to Superman's archenemy, Lex Luthor, repeatedly causing trouble for Detroit long after he left.

"He's a master criminal," she said. "His intent is devious. That's what it seems like to me Mr. Kilpatrick has done. We need to know where every penny has gone."

Kilpatrick, who now lives in Texas, couldn't be reached for comment. His criminal attorney, James C. Thomas, said he didn't have enough information to comment.

No one answered the door of Wood's downtown Baltimore home Monday evening.

Wood was selected as monitor in June 2003, roughly when the text messages began, above objections from the council, and has gone to court to increase her compensation.

Kilpatrick "moved heaven and earth to get (her) hired," lobbying "heavily for her," said Councilwoman Sheila Cockrel. At the time, Wood worked for Kroll, an international firm that also implemented a consent decree in Los Angeles. The former federal prosecutor left Kroll to form Venable LLP, with offices in Baltimore and Washington, D.C., since then.

Wood has worked for Kroll as an independent monitor, Kroll said in a statement.

The consent decree, signed to end a class-action suit about police brutality and jail conditions, was supposed to last five months. It's expanded to years as the city struggled to implement procedural changes and capital improvements such as new holding cells. Initially, the monitor's fee was $250 an hour, but she successfully lobbied for a 15 percent pay bump to $287.50 an hour.

Her fees were supposed to decline as the city implemented reforms, but after six years, she found the department had met only 73 of 203 provisions of the decree.

As of June, the monitor was paid $180,000 a month by the city.

Green said the city -- which does not have the text messages -- is now reviewing thousands of pages of billing records and invoices to determine what impact the relationship may have had on the city's progress.

By Friday, the Justice Department and city of Detroit plan to have an interim monitor in place for 30 days. By the end of the month, the two sides hope to agree on a monitor. If they can't, they will each submit a name. The city will accept proposals outlining the costs of monitoring.
Public hearings vowed

Councilwoman Alberta Tinsley-Talabi and several other council members vowed public hearings on the latest scandal.

"There's going to be a thorough investigation of this," Tinsley-Talabi said.

Calls to Wood's offices weren't returned.

Larry Dubin, a University of Detroit-Mercy law professor, said Wood could face legal disciplinary action or criminal charges, which may lead to the city recouping some of the fees.

"It's fair to assume there was a serious inappropriate part of her relationship with Kilpatrick," he said.

The latest scandal began to percolate last Friday when U.S. District Judge Julian Abele Cook, who oversees the consent decree with the U.S. Justice Department, announced that Wood resigned after being confronted with documents that showed she had "meetings of a personal nature" with Kilpatrick. Reaction from the Detroit community was one of muted surprise, given the other revelations regarding Kilpatrick over the past several years.

"Nothing shocks me anymore about this whole text message case; this is just another person who's wrapped up in it," said former Detroit Police Deputy Chief Gary Brown, who won a whistle-blower lawsuit against Kilpatrick that eventually led to the release of the text messages. "It's a shame this saga doesn't seem to end.

"When the mayor has the kind of power that he had, and was acting in such an unethical way, you can have all the checks and balances in the world and it won't stop that type of behavior."

Political consultant Adolph Mongo, once one of Kilpatrick's biggest defenders, said he's baffled about the mayor continuing to "let a lot of people down."

"It's set the city back another decade," he said. "It's going to take a long time to dig us out of this mess."

Default $21K in gear missing from Monica Conyers' office

An inventory of Conyers' office found that 29 city-owned items are missing, including notebook and desktop computers, digital cameras and software, according to a memo dated today from Council President Kenneth Cockrel Jr. Two of the notebook computers were ordered by Conyers' staff two weeks before she resigned July 6 after pleading guilty to a federal charge of conspiracy to commit bribery, according to a memo obtained by The Detroit News.
Cockrel wrote that he's written to Conyers' attorney, Steve Fishman, and told him he expects a response soon.



"Unless an appropriate response, inclusive of the return of a significant number of missing items in a timely fashion is received by Ms. Conyers, I intend to notify local law enforcement authorities," Cockrel wrote.
Cockrel said in the memo to fellow council members that he suspects the equipment loss may have taken place over several years. The inquiry began after Cockrel received a report from a staffer that computer equipment was removed prior to Conyers' resignation.
Cockrel said he tried to have a letter delivered to Conyers detailing the missing equipment but was unable to deliver it to her.

Dixon, speaking Wednesday evening before addressing a forum for minority- and women-owned businesses, said she is "staying focused" on her agenda for the city which includes reducing crime and making Baltimore cleaner and greener.

"Hey, you know, it makes you stronger," she said of the continuing legal battle and the prospect of fighting a new round of indictments.

ALEXANDRIA, VA. -- The jury in the William Jefferson corruption trial completed its second day of deliberations Friday without reaching a verdict, breaking about 90 minutes early to go home for the weekend.

Judge T.S. Ellis said he agreed to let jurors retire ahead of the usual 5:30 p.m. ending time to accommodate the wishes of one or more jurors.

The jury of eight women and four men will resume deliberations Monday at 9:30 a.m.

Shortly before their lunch break, jurors sent Ellis a note saying they were satisfied with the audiotape of the judge's lengthy jury instructions from Thursday and were dropping their request for a written copy.

Jefferson, 62, a Democrat who represented the New Orleans area 2nd Congressional District for nine terms, faces 16 charges, including bribery, racketeering and six counts of "honest services" fraud, a charge Jefferson's attorney Robert Trout in his closing arguments called the government's backup in case jurors, "as you should" reject the bribery allegations.

The honest services fraud statute allows prosecutors to bring felony charges against public officials and corporate leaders who "deprive another of the intangible right of honest services."

It's a popular tool for prosecutors, particularly in government corruption cases, although critics, including Supreme Court Justice Antonin Scalia, complain it is too vague. Scalia wrote that it "invites abuse by headline-grabbing prosecutors in pursuit of local officials, state legislators and corporate CEOs who engage in any manner of unappealing or ethically questionable conduct."

Trout likened the prosecution of Jefferson to the Maxwell Smart secret agent character in the old TV sitcom and recent movie "Get Smart, " in which Smart says outrageous things until he is challenged and then responds, "Would you believe . . . ?"

With the same sense of false bravado, Trout said, the prosecution charged Jefferson with bribery, for promoting businesses in Western Africa in return for payments to family owned businesses. If that fails to sway jurors, Trout said, prosecutors have a second option, the six honest services fraud allegations. Trout said the prosecution fell well short of proving any of the charges.

Prosecutor Rebeca Bellows told jurors that prosecutors provided more than enough evidence for them to find Jefferson guilty on all counts.

Legal experts say the honest services fraud charges, which carry a maximum penalty of 20 years for each count, pose a real danger for Jefferson.

"Honest services is so broad that it is generally easier to prove than the bribery counts, " University of Richmond constitutional law professor Carl Tobias said.

Harry Rosenberg, a former federal prosecutor in New Orleans now in private practice, said the bribery charges related to Jefferson's promotion of businesses in Western Africa are sort of a "new frontier" in terms of legal issues, which make them harder to prove.

But the honest services charges, which relate generally to what the Justice Department says was Jefferson's failure to disclose conflicts of interests based on his promotion of projects without disclosing that he had a financial interest, are like those routinely filed by prosecutors.

In the past two weeks alone, two public officials in New York and Pennsylvania have pleaded guilty to honest services fraud and many, if not all of the 44 people caught up in a public corruption sting in New Jersey, are likely to be charged with honest services fraud, among other allegations.

There is, however, some hope for those officials and for Jefferson.

The U.S. Supreme Court, which previously had, much to Scalia's consternation, refused to take up a challenge to the statute, recently agreed to take two cases challenging honest services prosecutions.

One deals with the conviction of media baron Conrad Black. The second deals with the attempted prosecution of Alaska state Rep. Bruce Weyhrauch, who is accused of seeking to do legal work for a company with a matter before the legislature.

Although neither case directly challenges the constitutionality of the honest services fraud statute, Lisa Casey, an associate professor of law at Notre Dame University, said the cases, given Scalia's interest, could affect both future and past prosecutions.

But relief for those accused or convicted of violations of the law, is something of a long shot, given that several appellate courts have ruled that the statute is not so vague as to make a person with reasonable intelligence have to guess as to its meaning, the general standard used by courts in a constitutional evaluation. http://www.nola.com/news/index.ssf/2...fers_corr.html

I'm really sorry the testimony didn't mention Jefferson's commandeering a military helicopter in the wake of Hurricane Katrina, pulling a unit away from rescuing his poor constituents who were suffocating in stifling attics or drowning in their homes so that he could go "check on his house." If anyone retained any illusions about Jefferson having so much as a shred of decency along with his money-grubbing, discussion of that fact would have laid that to rest. There is absolutely nothing about the character of that man that is redeeming, including the fact that he could flash such a broad, seemingly oblivious smile in the wake of such damning testimony while facing 235 years behind bars. That leads one to question his sanity. I hope, for the sake of the citizens of New Orleans, that he gets the entire 235 years, and that they send his siblings to join him soon. I believe that it will take the entire 235-year period for him to experience a shred of remorse.

Jefferson faces up to 150 years in prison and could face forfeiture of payments totaling $456,000, plus stock certificates, according a spokesman for the U.S. Attorney's Office in Virginia, where Jefferson was tried. Jefferson can appeal his conviction.

The former congressman was not taken into custody.

Jefferson, in Congress since 1991, narrowly lost his re-election bid in 2008 to Republican attorney Anh "Joseph" Cao who became the first Vietnamese American in the House of Representatives. The district includes most of New Orleans, which was ravaged during Hurricane Katrina in 2005.

When he was first charged, Jefferson acknowledged he had made unspecified mistakes in judgment that he regretted, but denied selling his office or trading official acts for money.

He also challenged the indictment, arguing that it unconstitutionally infringed on his privileges as a lawmaker. But the courts held that the grand jury did not improperly consider any legislative material.

Jefferson faced 16 counts of racketeering, soliciting bribes, fraud, money laundering, obstruction of justice, conspiracy and violating the Foreign Corrupt Practices Act.

The business ventures included telecommunications deals in Nigeria and Ghana, oil concessions in Equatorial Guinea, satellite transmission contracts in Botswana, Equatorial Guinea and the Republic of Congo, and a Nigerian sugar plant.

to be fair (even though they dont deserve it) most politicians in general are criminals. but when you give a nigger a political position, you get some kind of supernigger, someone who not only has the desire to commit crimes but the intellect to do so. watch out! one black politician is more dangerous than 1000 angry niggers with tec 9s.

In September, Kilpatrick resigned as mayor and pleaded guilty to two felony obstruction of justice charges stemming from his efforts to cover up his relationship with Beatty.

"It is not a crime to live like the privileged. But we are here because you committed perjury, you pled guilty and you agreed to pay $1 million in restitution. But you have not been responsible in paying it. You have not been credible in this courtroom, and you again have not been honest to the City of Detroit."
Kilpatrick was ordered, 90-days to pay $319,011.Freep.com reported that this was by far the worst day in court Kilpatrick has had since he was sentenced.

Only $1,392 of at least $31,000 raised to help Katrina families was paid, tax records show, and just about everybody involved with the charity -- including the two Democratic pols -- claim ignorance as to where the rest of the money went.
Meeks said in a statement that "the funds were utilized to help sustain displaced evacuees," but refused to provide further detail. He said money was administered by an unidentified director and that "a committee of community representatives functioned as advisers to the fund."
