Default Mexican mayor of AZ town arrested by FBI in $3.2 million scam

NOGALES, Ariz. (KGUN9-TV) - If the FBI and Arizona Attorney General Terry Goddard are right, the embattled mayor of Nogales is no small time crook. He's a really big one.

Late Tuesday afternoon Nogales Mayor Octavio Garcia-Von Borstel appeared before Santa Cruz County Justice of the Peace Mary Helen Maley to face multiple charges of corruption, fraud and bribery. Appearing with him was his father, 59 year old Octavio Garcia Suarez, who faces similar charges.

Judge Maley set a bond of $250,000 for each defendant. The two will be able to get out of jail by paying 10% down. It was not clear by Tuesday evening whether the two would be able to post bond in time to avoid spending a night in jail. (this sort of deal is usually saved for jews - steal $3.2 million, bond out on $25,000)

FBI agents took Garcia-Von Borstel into custody Tuesday morning, arresting him in his office at Nogales City Hall. Among the accusations: that the mayor took part in a scheme that ripped off Western Union to the tune of $3.2 million. And it doesn't stop there.

Goddard's office issued a press release about the arrest around 10:00 AM Tuesday morning. The press release contained a statement from Nathan T. Gray, described as an FBI Special Agent in Charge of the Phoenix Division. The statement read, "Today's arrest of Mayor Von Borstel has been a collaborative effort with the FBI's Southern Arizona Corruption Task Force and the Arizona Attorney General's Office.... When a public official allegedly commits criminal acts it erodes the public's trust. The FBI and our law enforcement partners are determined to address public corruption at all levels of government."

The Attorney General's press release confirmed the arrest. It also said that while that was happening, other agents executed search warrants at his home, business and city hall office.

According to the press release, agents began investigating Garcia-Von Borstel five months ago. The release stated that mayor was "soliciting Nogales businesses to hire him as a business consultant as early as February 2009. At least one business admitted to the FBI that it was paying the mayor to use his official position to obtain business contracts and, specifically, to obtain new City of Nogales contracts, circumventing either open bidding or proper application processes.

Garcia Von-Borstel's father is in an equal amount of trouble. The press release stated that Garcia Suarez bilked his employer, Western Union, of $3.2 million in money orders, which the mayor then deposited into a bank account that he controlled. According to the statement, the father and son had already withdrawn more than half a million of that for their personal use before investigators froze the account.

The press release quoted Attorney General Terry Goddard as saying, "These charges are serious violations of the law. Because some charges involve the official actions of an elected official, they violate the public trust.... Both the mayor and his father will be held accountable and prosecuted to the full extent of the law."

In court Tuesday afternoon, the mayor's attorney told the media that the charges against Garcia-Von Borstel are nothing more than an election year ploy by Goddard, who is running for governor.

The charges do not appear to be related to accusations documented in a 9 On Your Side investigation earlier this year. That investigation found that the mayor racked up thousands of dollars in expensive meals and trips, taken at taxpayer expense. The mayor refused repeated requests to speak with KGUN9 News about the charges, but insisted to other media that the expenses were justified, even though he never backed up that claim with documentation.
