Why was the Leo Frank trial one of the most famous courtroom dramas in the history of the American South and Georgia jurisprudence?

The alibi Leo Frank claimed from his first contact with Atlanta police on Sunday morning April 27, 1913, till Monday afternoon, August 18, 1913 -- almost three and a half months -- was that he "never left" his second floor window-front business office at the National Pencil Company, when Mary Phagan arrived and was alone with him there between 12:05 pm through 12:10 pm on the day of the murder, Georgia Confederate Memorial Day, Saturday, April 26, 1913.

But there was one VERY VERY big problem with Leo Frank's alibi, because, Monteen Stover, testified she found Leo Frank's office empty between that exact same time segment from 12:05 pm through 12:10 pm on April 26, 1913.

Leo Frank was caught in a lie which was inescapable. To explain the inconsistency away as to why he was not actually alone with Mary Phagan in his office between 12:05 pm through 12:10 pm on that fateful Saturday, as he had formerly and adamantly stated to the police in a stenographed deposition on Monday, April 28, 1913, he came up with a new solution:

Putting himself at the scene of the crime at the exact time it occurred!!

This Monteen Stover created inconsistency or contradiction became the crux of the sexual homicide case and Leo Frank's newfangled explanation on August 18, 1913, was ineluctably earth-shattering -- he actually changed his alibi while seated on the witness stand and placed himself directly at the place his black sweeper, James "Jim" Conley, testified on August 4, 1913, about where he first saw Mary Phagan dead with a cord around her throat. Jim Conley testified to the jury Leo Frank confided that he sexually propositioned Mary Phagan in the metal room, she refused the offer, so Leo struck her, and she hit her head against something...

The autopsy of Mary Phagan revealed someone punched her in the eye (Leo Frank's fist) and she had hit the back of her head on something (handle of the lathe) knocking her unconscious.

Forensic evidence was found in the machine department (colloquially known as the metal room) on Monday morning, April 28, 1913, in the form of hair with dried blood tangled on the handle of a lathe and in front of the entryway to the men's toilet was a 5 inches wide dried blood puddle which someone tried to erase by putting a white powder lubricant over it, but because the wooden floors were deeply grimy with oil dirt, the blood spatter soaked through the powder creating variations of maroon, red and pink that was conspicuously noticeable. The murderer had failed to ensure the metal room was properly cleaned of all the forensic evidence, so it didn't matter whether or not the dead body of Mary Phagan was removed two floors below to the basement. Mary Phagan's body had been dragged in the basement of the factory, apparently to make it seem like a struggle had occurred there with her assailant, but when the physicians looked at her skin and noticed none of the scratch marks were showing any signs of bleeding, they instantly knew she was already dead when she was in the basement, opening the likelihood she could have been killed on an upper floor, probably either on the first floor lobby or second floor.

Even the lowest IQ newbie police officers could have easily put two and two together, thus this was not at all a difficult homicide to solve. Even amateurs could solve this crime based on the forensic evidence and trial testimony, alone. The police had the opportunity to interrogate the prime suspects for weeks using the third-degree method and finally got the best approximation of what really happened on the day of the sex-homicide.

The most sensational criminal trial in Southern history that began on July 28, 1913, concluded its testimony portion on August 21, 1913. Amazingly, the trial ended just a few days after Leo Frank made a startling admission on the witness stand (August 18, 1913), some say the pre-written oral statement amounted to a kind of "virtual" murder trial "confession".

Most people with common-sense who followed the trial proceedings understood what Leo Frank revealed at the witness stand about "unconsciously" going to the scene of the crime, when the crime occurred, basically made it impossible for him to be anything other than guilty of strangling the teenaged girl who worked for him as a child laborer in his sweatshop. It was impossible to do anything other than convict him after he changed his alibi and placed himself at ground-zero where the murder of Mary Phagan was theorized by the police and proposed by the prosecution to jury as having actually happened.

On August 18, 1913, Leo Frank mounted the witness stand and revealed the solution to the Mary Phagan murder mystery stating he might have "unconsciously" gone to the bathroom in the metal room (the place Jim Conley testified was the scene of the crime) to counter Monteen Stover's testimony that he (Leo Frank) was not in his inner or outer office between 12:05 P.M. to 12:10 P.M. on April 26, 1913.

Entered into evidence was a stenographed deposition unsigned of Leo Frank stating to the police he was alone with Mary Phagan between 12:05 p.m. and 12:10 p.m. (See State Exhibit B, Brief of Evidence, 1913) in his window front office at the front section of the building on the second floor.

Visualize this:

Leo Frank's office was on the second floor at the front section, Mary Phagan's workstation was at the back of the second floor in the metal room, where she had worked for nearly one year and the very place she worked was next to the entryway of the men's toilet.

The prosecution's developed theory based on affidavits and forensic evidence was that Leo Frank coaxed Mary Phagan to go into the metal room to see if her work materials had arrived (brass sheet metal), then he went with her and used her uncertain job status as a species of sexual coercion, when she refused him, he took what he wanted by force and then strangled the young girl so she wouldn't be able to tell anyone what happened. He really had no other choice but to kill her, had she told her parents and police that Leo Frank beat and raped her, his reputation would have been destroyed and a lengthy prison sentence on the chain gang would follow, if he was lucky enough not to be castrated and lynched by a mob of White Christian Southern avengers.

While Seated on the Witness Stand (August 18, 1913), Leo Frank stated, to his trial jury and presiding judge Leonard Strickland Roan, the reason why Monteen Stover had found his office empty between 12:05pm and 12:10pm on April 26, 1913:

Now gentlemen [of the Jury], to the best of my recollection from the time the whistle blew for twelve o’clock [noon on Saturday, April 26, 1913] until after a quarter to one [12:46 p.m.] when I went upstairs and spoke to Arthur White and Harry Denham [at the rear of the fourth floor], to the best of my recollection, I did not stir out of the inner office [at the front of the second floor]; but it is possible that in order to answer a call of nature or to urinate I may have gone to the toilet [in the machine-department's bathroom at the rear of the second floor]. Those are things that a man does unconsciously and cannot tell how many times nor when he does it (Leo Frank Trial Statement, August 18, Brief of Evidence, 1913; Georgia Supreme Court Brief, 1913, 1914).

The 5'8" tall Leo Frank also told the jury the reason 5'1" tall Monteen Stover did not see him in his inner office located at the front of the second floor was because a 4-foot tall safe door was open. So Leo Frank simultaneously placed himself in his office hiding behind a 4-foot tall safe door and in the metal-room at the exact same time, where the murder had occurred at the same time. The 4-foot safe door didn't stop the 4'11" tall Mary Phagan from seeing Leo Frank, nor did it stop anyone else that day from seeing him, but he expected the jury to believe Monteen Stover at 5'1" and looking for him for 5 minutes in his office would somehow not see him, so he fell back on the most incriminating other option, placing himself alone at the scene of the crime when the murder occurred.

8 months later, Leo Frank re-confirms he might have been in the machine-department's bathroom (men's toilet in the metal-room) at the time Monteen Stover said his office was empty: See the Atlanta Constitution issue of Monday, March 9, 1914, Leo Frank Jailhouse Interview (Available on the Internet Archive). Why would he continue to do something so stupid, even 8-months later is beyond comprehension, but he did. Leo Frank double-downed on being at the scene of the crime, and when the murder of Mary Phagan occurred. What could any normal person with average intelligence and commonsense do but come to the conclusion he did the dirty deed?

The murder trial at the time was the longest and most costly in Southern history. Leo Frank had the best lawyers money could buy at the time and the lawfirm he hired, had as one of its partners the Governor of Georgia, John Slaton. Governor Slaton commuted the death sentence of his lawfirm's client Leo Frank on June 21, 1915, it was obviously illegal and led to widespread outrage, even today. Two months later a band of heroes, led by members of the Atlanta state government, including former Georgia Governor Joe Brown, removed Leo Frank from prison on August 16, 1915, drove him to Marietta, and gave the sex-killer a very clean and clinical execution on August 17, 1915.

JUSTICE SERVED.
