Default After acquittal in death of cab driver, Johnathan Mitchell indicted in cab robbery

Apr 26, 2016

The man acquitted in the 2011 homicide of a local cab driver has now been charged in federal court for robbing her at the time of her death.

Johnathan Dewayne Mitchell, 38, of Cedar Rapids, was indicted Tuesday of one count of robbery affecting commerce in U.S. District Court. The indictment states Mitchell obstructed commerce — the cab company service — by “violently” robbing Catherine “Cathy” Stickley, 54, who was driving a Century Cab on April 29, 2011.

Mitchell was acquitted in 2013 by a Story County jury for first-degree murder and first-degree robbery in the homicide of Stickley, 54, of Cedar Rapids, who was stabbed to death that night in 2011.

Default Sentencing delayed for teen convicted in shooting death of South Bend two year-old

Apr 26, 2016

SOUTH BEND - A teen convicted of Murder in the death of a South Bend two year-old will not be sentenced until next month.

Tyre Bradbury appeared in a St. Joseph County courtroom Tuesday morning to be sentenced in connection with the death of John Swoveland Jr., who was killed by a stray bullet from a gang shooting two years ago. Bradbury, 17, was convicted of Murder earlier this month in Swoveland's death.

Bradbury's attorney requested consideration of a juvenile sentencing statute that would allow Bradbury to be sentenced as a juvenile for now, and then re-sentenced when he turns 18, and the hearing was adjourned to allow time to consider the statute. Bradbury's mother also testified in court to ask for leniency, and said that Bradbury had a difficult childhood, was only 15 at the time of the shooting and is "just a kid that made a mistake''

Default Attorney: Man Who Fatally Shot Two Teen Girls Should Get Manslaughter

April 26, 2016

OAKLAND — Diantay Powell’s defense lawyer admitted Tuesday that Powell brutally gunned down two teenage girls near Brookdale Park in East Oakland in 2012 but said he should only be convicted of voluntary manslaughter because he had a troubled childhood.

In his opening statement in Powell’s trial in Alameda County Superior Court, defense attorney Darryl Stallworth said Powell “was walking around with no decision-making ability” because he’d been forced to move from home to home as a child, began using drugs at the age of nine and started taking painkillers after he was shot 14 times when he was only 13 years old.

“My client, Diantay Powell, is responsible for the deaths of Bobbie Sartain and Raquel Gerstel but the issue you will struggle with is whether it was first-degree murder, second-degree murder of voluntary manslaughter,” Stallworth told jurors.......

Default Supreme Court To Hear Nine Mile Popeye’s Murder Case

April 30, 2016

The Florida Supreme Court will hear arguments Thursday in a high-profile case that forced an overhaul of the state’s death-penalty sentencing system.

The case involves Timothy Lee Hurst, who was sentenced to death for the 1998 killing of fast-food worker Cynthia Harrison in Pensacola. Harrison, an assistant manager at a Nine Mile Road Popeye’s Fried Chicken restaurant where Hurst worked, was bound, gagged and stabbed more than 60 times. Her body was found in a freezer.

Hurst was the plaintiff in a legal challenge that led to the U.S. Supreme Court finding in January that Florida’s death-penalty sentencing system was unconstitutional because it gave too much power to judges, instead of juries. State lawmakers and Gov. Rick Scott quickly approved changes to the system to try to resolve the constitutional issues.........

Quinton Verdell Tellis, the man charged with capital murder in the 2014 burning death of Jessica Chambers, has a Louisiana court date in the coming days, and District Attorney John Champion says Mississippi has done all it can do to clear the path for this return.

Tellis is due in court May 9 in Ouachita Parish, Louisiana, in connection with a case there. Champion — whose district includes Courtland, where Chambers' burning death occurred in December 2014 — said Saturday he wasn't sure how long it would take to get Tellis back in Mississippi, but all the necessary paperwork has been filed through the governor's office for extradition.......
