A petty thief sprung from jail so she could get a heart transplant landed back in the slammer yesterday, forcing her off a list for the life-saving procedure, her lawyer said.

Diane McCloud, 48, of Hempstead, was charged with shoplifting at a CVS store in July, and faces an approximate year in jail when she’s sentenced on Sept. 21.

The sentence will include the time she never finished serving on two misdemeanors when a Long Island judge took pity and freed her last January to prepare for a possible heart transplant.

"Originally the goal was legally to get her out of jail so she could become a heart transplant recipient," said her lawyer, Leonard Isaacs of Valley Stream. "The only goal was to save her life."

A new arrest nixed petty thief Diane McCloud's heart-transplant bid.Isaacs said McCloud is desperately ill and that her prognosis is dire without the transplant. But inmates are not allowed to get transplants because of the costs and risks.

"It’s sad that it came to a very abrupt and unfortuante end," Isaacs said.
