One wonders what the fallout from Obama will be. Corruption is just par for the course with niggers whether they are jail guards or politicians.

Four men and eight women are expected to begin deliberating in Riddle's political corruption trial as soon as they finish their lunches. US. District Judge Avern Cohn finished instructing the jurors on the law shortly before 1 p.m.
The court drew lots to dismiss three alternate jurors from the pool of 15. One of two black women on the jury was among the three sent home, leaving a jury of 12 with one African-American woman and another woman who is non-white. The racial make-up of the jury was an issue of concern raised by Riddle's attorneys before the trial began.



Riddle, 63, a political consultant and onetime aide to former Detroit City Councilwoman Monica Conyers, is charged in a seven-count indictment with felonies that include conspiracy, extortion and lying to the FBI.
In seven days of testimony before a jury and U.S. District Judge Avern Cohn, the trial heard evidence that Riddle and Conyers teamed up to shake down businesses with matters before the City Council or Detroit's General Retirement System, where Conyers sat as a trustee.
Riddle's former live-in companion, former state Rep. Mary Waters, sat in the front row of the packed courtroom for the closing arguments.
Riddle's bond includes a no-contact clause with Waters. He is accused of a felonious assault against Waters involving pulling a shotgun after she allegedly came home to discover him in bed with another woman shortly before Christmas.
Assistant U.S. Attorney David Gardey said Riddle is "a political pimp" who helped to corrupt the city of Detroit, a prosecutor told jurors today in the closing argument at Riddle's criminal trial.
"Sam Riddle was a political pimp and he sold Monica Conyers' vote to the highest bidder," Gardey said. "That's all you really need to know about him."
Gardey said Riddle and Conyers "worked together to abuse their positions of public trust to enrich themselves."

In an emergency motion released Thursday, former Detroit Mayor Kwame Kilpatrick said he cannot afford to pay the revised court-ordered restitution.

On Jan. 20, after a six-day hearing, Wayne County Judge David Groner ordered Kilpatrick to make a lump sum payment of $79,000 within 30 days and another payment of $240,000 within 90 days."This motion is being brought as 'emergency' because the defendant has as of yet not been able to come up with the amount of restitution the court has recently imposed and is unlikely to do so within the time allowed by the court," the motion filed by Kilpatrick's Farmington Hills-based attorney Daniel Hajji stated.Kilpatrick attorney Michael Schwartz said "We're asking the judge to reconsider what he has ordered."Schwartz said Judge Groner's ruling was "a clearly erroneous ruling which does not meet the requirements of the law."

The motion asks that the revised payments be canceled because Wayne County prosecutors failed to prove the changes were needed and that Kilpatrick had the sufficient resources to make the new restitution payments.Attorney David Griem, who is not connected to the case, said Kilpatrick's argument seems to be that he should not be held responsible for money he had in the past."Despite the fact that he had hundreds of thousands of dollars go through his accounts, his position is, 'That's past history', and today he can't come up with the money ordered by the court," Griem said.Kilpatrick had agreed to pay $1 million in restitution in late 2008 as part of pleas in two criminal cases, but later requested that his monthly payments be reduced.Kilpatrick fulfilled a requirement to pay $36,000 during the six months after his jail release. But when his base pay at Texas-based Covisint dropped from $20,000 to $10,000 per month, Kilpatrick began to make $3,000 payments based on 30 percent of his income, something Kilpatrick's lawyer, Michael Alan Schwartz, argued was part of Groner's earlier order.The new restitution hearings began in October.

Default Sam Riddle walks thanks to lone nigger juror...

DETROIT (AP) -- A judge declared a mistrial Wednesday in the federal corruption case against Detroit political consultant Sam Riddle after an impasse by jurors, who described deliberations as tinged with racial tension they blamed on a lone holdout.
Riddle, who is black, was charged with teaming up with his former boss, Monica Conyers, to extort bribes from people in 2006 and 2007. Conyers was a member of the Detroit City Council until she pleaded guilty to conspiracy and resigned last summer. The government says the pair shook down people for cash in exchange for favors.
U.S. District Judge Avern Cohn stepped in on the sixth day of deliberations, declaring a mistrial and sending the jury home. Despite Cohn advising them not to discuss the case, several jurors vented their frustrations to reporters that the lone black on the 12-person panel continually injected race into their talks.
"If you can't find this man guilty, you can't find anyone guilty," Margaret Elyakin declared on the steps of the federal courthouse. "Unfortunately, it came down to race. This is very disappointing."
Federal prosecutors said they would retry Riddle.
"Getting a unanimous verdict from a jury is difficult," U.S. Attorney Barbara McQuade said. "We accept the results of the jury system and we will try again."
Several jurors described a jury room bordering on mayhem.
Matt Lefevre said there was screaming during deliberations. "She wouldn't sit at the table half the time," he said of the holdout juror.
At one point, the woman sarcastically said, "Let's hang the black man," according to another juror, Jay Gandhi. Gandi said she thought the holdout was going to hit her with a folder.
The holdout, who walked outside with the other jurors, declined to give her name. She said Riddle's trial was "interesting" but otherwise refused to comment.
Before the start of his trial, the glib Riddle told reporters he had done nothing wrong. Riddle, who was Conyers' top aide, also noted he was a private contractor, not an elected official.
He appeared relieved when speaking with reporters following Cohn's ruling.
"The American system of justice worked and we proceed with round two," Riddle said before leaving court with his two sons.
McQuade declined to say whether the government would prosecute him on the same charges.
Riddle's defense attorneys declined to comment, citing a judge-imposed gag order.
A status conference on the case is scheduled for Thursday.
The mistrial is a rare setback in the government's investigation of corruption associated with Detroit City Hall.
Sentencing is scheduled for next month for Conyers, the wife of Democratic U.S. Rep. John Conyers. She pleaded guilty in June to bribery charges and admitted taking cash from Houston-based Synagro Technologies, Inc., in exchange for her vote on a $47 million sludge-treatment contract.
Riddle was charged with getting cash to Conyers for her Synagro vote. Conyers faces up to five years in prison and a $250,000 fine.
Besides Conyers, at least eight other people have been convicted, all in plea deals with the government.
They include two former directors of the downtown convention center, Synagro's Michigan representative and two brothers who were top aides to Kwame Kilpatrick before he resigned as mayor in 2008.
In addition to a retrial in the Detroit case, Riddle is scheduled to go to trial on June 1 on accusations that he bribed a city councilman in the suburb of Southfield over the relocation of a pawn shop. He has pleaded not guilty.

David Paterson, who repeatedly and defiantly said he would let voters decide if he should run the state, abruptly quit his nascent election bid Friday amid a stalled agenda, faltering popularity and criticism of his handling of a domestic abuse case involving one of his most trusted aides.
Democratic officials in Washington and a person briefed by Paterson in New York were informed of his plans early Friday. The officials spoke on the condition of anonymity because Paterson had not publicly disclosed his decision.
Paterson planned a 3 p.m. news conference at his New York City office, where he was expected to announce that he's quitting the race.
Paterson, who had publicly prided himself on beating the odds, including overcoming blindness to rise through treacherous New York politics, formally announced his campaign last weekend but faced mounting calls to drop out of the race in the midst of controversy. A top aide is ensnared in a domestic-violence scandal, the governor was finding dwindling support in his own party and his campaign bank account paled in size to those of his rivals.
Paterson became governor in 2008, when former Gov. Eliot Spitzer resigned in a prostitution scandal. Paterson's decision paves the way for Andrew Cuomo to make an unimpeded run for the Democratic nomination.
"The governor isn't feeling pushed out," said a person who talked with the governor about his decision and who spoke to the AP on the condition of anonymity because Paterson hadn't yet announced why he was ending the campaign. "He certainly realizes it's very difficult to do a campaign and govern, and the focus now is on governing and the best interests of the state."
Paterson's decision comes just 19 days short of his two-year anniversary as governor.
"He started out as a nice guy with the best wishes from everyone, and it just went downhill," said Maurice Carroll of the Quinnipiac University poll. "As a personal story, it's too bad because everyone who ever knew David Paterson liked him. As a governmental story, it's partly him and it's partly Albany. Albany is dysfunctional, and collectively they are awful."
Paterson was the scion of a Harlem political power base that included his father, former state Secretary of State Basil Paterson; the late Percy Sutton, who was Manhattan borough president; Rep. Adam Clayton Powell; former Mayor David Dinkins; and embattled U.S. Rep. Charles Rangel.
Now, Paterson's gubernatorial campaign will end amid a domestic violence scandal involving a trusted aide from Harlem, David Johnson. More than a decade ago, Paterson took Johnson on as an intern as part of his efforts to give youths snared in Harlem's crack epidemic a second chance.
On Wednesday, the most alarming call for Paterson to end his campaign came from state Sen. Bill Perkins, the Democrat in Paterson's old Harlem seat, who told the AP that Paterson's cabinet is "falling apart" and his campaign weakened.
"The crisis we are suffering in this state and in the community is being distracted by these reports and very, very serious allegations," Perkins said. "What we are learning is unacceptable, and the viability of his candidacy is obviously crippling."
It has been widely expected - and among some Democrats, eagerly awaited - that the more popular Cuomo would run for governor and help prop up the state's reeling Democratic party. Cuomo, son of former Gov. Mario Cuomo, has already built a campaign fund five times larger than Paterson and consistently outpolls Paterson among New York Democrats, who hold a 2-to-1 edge over Republicans statewide.
Paterson's campaign "was going nowhere very quickly and the numbers couldn't have been any more bleak for him before this," said Lee Miringoff of the Marist College poll. "Regardless of the legalities involved and this specific controversy, the odds of him taking the oath of office next January were very remote."
Paterson's decision lets Cuomo avoid an expensive and divisive primary, Miringoff said.
For Republican candidate Rick Lazio, it means he can no longer try to split the Democrats and now must confront the far better funded and more popular Cuomo.
Paterson has been weighed down by low approval numbers for months. His problems intensified in recent weeks with a series of critical articles in The New York Times. The last, published Thursday, raised questions about how Paterson and state police officials responded to a domestic abuse complaint lodged against Johnson.
Court papers said state police may have pressured the woman, Sherruna Booker, to not level criminal charges against Johnson. The newspaper also said Paterson spoke with the woman personally, although the governor's office said it was the woman who placed the call.
Booker's attorney, Lawrence Saftler, declined to comment on the Paterson matter Friday, "pending the outcome of an investigation by the attorney general's office and his capable staff."
Renewed calls for Paterson's exit were made hours after the story's publication, including one from a longtime ally, Rep. Steve Israel. The Long Island Democrat said he felt compelled to tell his friend that he should not seek election to a full term.
Paterson, an affable, slightly built politician, was never really seen as gubernatorial in the eyes of legislators, lobbyists or voters. He was Senate minority leader when he was picked by Spitzer to be his running mate.
Five days after the Spitzer prostitution scandal broke, Paterson bounded into office March 17, 2008, loudly proclaiming, "I am your governor!" It was welcomed statewide after 14 months under Spitzer, who started with a rush of reform only to be bogged down in scandal and gridlock after his aides were accused of using state police to track a political enemy.
Paterson immediately confronted allegations of sexual affairs and drug use, some of which were true. He held a news conference detailing past affairs he and his wife were involved in during an 18-month period when it appeared their marriage would end. He also recounted past drug use from his youth. He said he made the extraordinary admissions so that he couldn't be compromised as governor and to avoid further fracturing of a government rocked by Spitzer's resignation.
His honeymoon was brief. He gained some popularitywith voters when he - nearly alone - warned of impending fiscal crisis in Albany. He also developed an image of talking tough but ultimately giving in to lawmakers.
His slide was hastened when his most trusted aide was forced to resign after press accounts revealed he hadn't paid taxes for five years.
Paterson's bungled handling of the appointment to fill the U.S. Senate seat vacated by Hillary Clinton angered Democrats, including the Kennedy family, when he passed over Carolyn Kennedy and then an aide leaked unsubstantiated rumors about her.
Paterson was also unable to stop a Republican-orchestrated coup in the Senate last year, then fought lawmakers over the budget, further weakening his support in the party.
He spent most of the last month denying persistent, unprinted innuendo about his personal behavior. Although none of it was proven, the rumors eroded the slight comeback he had made in polls since December.
"We in public service and in life have all these great plans," Paterson said in a press event in Queens in the fall. "There's an old Jewish expression, I can't quote it, that man plans and plans and plans and God laughs. Because things change in a moment ... 24 hours in politics is a lifetime."

When new details emerged in the spring of 2006 about the $90,000 FBI agents found in then-Rep. William Jefferson's home freezer, Rep. Charlie Rangel, D-N.Y., was tasked by his party's leadership to ask Jefferson to step down from the powerful House Ways and Means Committee.

On Wednesday, after some Democrats made similar pleas to Rangel, the 20-term congressman announced he is temporarily stepping aside as Ways and Means Committee chairman in the face of an admonishment this week by the House Ethics Committee and other ongoing ethics investigations.

Four years ago, Democrats were hoping the fall's election would put the party back in the majority and Rangel into the chairmanship of Ways and Means, in part because of ethical lapses by some congressional Republicans.

"Come on Jeff, I don't have much time left. Just do this for me," Rangel told Jefferson, according to one of Jefferson's former aides who asked not to be identified. Rangel, who was 75 at the time, was joined by Rep. John Lewis, D-Ga., both, like Jefferson, senior members of the Congressional Black Caucus.

Jefferson rejected the advice, and a few weeks later was ousted from the tax-writing committee by a 99-58 vote of his Democratic colleagues. He was found guilty in the summer of 11 of 16 corruption charges and sentenced to 13 years in federal prison. He remains free pending appeal.

Rangel had been something of a mentor to Jefferson. When Jefferson ran unsuccessfully for governor in 1999, he suggested that a Times-Picayune reporter get a quote from Rangel for a pre-election profile. And Rangel obliged, calling Jefferson a "very, very serious legislator."

Rangel, now 79, did rise to chairman of Ways and Means in 2007, after the Democrats won back the House majority. Even Jefferson, despite publicity over the corruption investigation and cold cash, managed to win a ninth term, though he was defeated in 2008.

Rangel's problems, though serious, are not at the level of Jefferson's.

The House Committee on Standards of Official Conduct found Rangel violated House rules by going on two Caribbean trips paid for by cooperate interests. The panel is still investigating his ownership of several rent-controlled apartments in New York City, his failure to pay taxes on some offshore property he owned and for using his congressional letterhead to seek donations for an educational center that was to bear his name.

But the New Yorker had become an embarrassment for Democrats, particularly House Speaker Nancy Pelosi, who has been criticized by Republicans for keeping Rangel as Ways and Means chairman despite her pledge to preside over the most honest, open and ethical Congress in history.

His decision to take "a leave of absence" Tuesday came after some Democrats, including Rep. Artur Davis, D-Ala., a member of the Congressional Black Caucus who took Jefferson's seat on the Ways and Means Committee, urged him to give up the chairmanship.

Ellenese Brooks-Simms

Federal prosecutors are recommending that former Orleans Parish School Board member Ellenese Brooks-Simms receive a drastically downgraded sentence for turning on her benefactor, political operative Mose Jefferson, and helping to ensure his conviction on bribery charges.

In a motion filed on Wednesday, prosecutors asked U.S. District Judge Martin Feldman to give Brooks-Simms 18 months instead of the six- to seven-year prison term called for by federal sentencing guidelines.

Brooks-Simms wore a wire tap that captured Jefferson proposing a variety of cover stories to ward off federal investigators. After pleading guilty to a single bribery count, she endured over a day of testimony at Jefferson's trial.

Jefferson was convicted of paying Brooks-Simms $100,000 in bribes for her support of the algebra software he was peddling. Based on Brooks-Simms' wiretap recordings, he was also convicted of two counts of obstruction of justice. He was sentenced in January to 10 years in federal prison.

Brooks-Simms is scheduled to be sentenced by Feldman on March 11. Her daughter, Stacy Simms, pleaded guilty to a related charge and will be sentenced on the same day by a different judge.

His sister, Betty Jefferson, pleaded guilty last week to a single federal conspiracy count in the same case, resigning her post as 4th District assessor a few days later.

Former U.S. Rep. William Jefferson, the most prominent of the Jefferson siblings, was sentenced in November to 13 years in federal prison for what a prosecutor described as "the most extensive and pervasive pattern of corruption in the history of Congress."

"I'm glad the government recognized her extraordinary cooperation," Capitelli said of Brooks-Simms. "There really wasn't anyone willing to stand up to the Jefferson gang. She wore a wire and made the case against Mose Jefferson. She's done a lot to help the whole community."

Perricone's motion describes the school board member's quick capitulation, once she was presented with evidence of her crime. She soon blossomed into a model government witness.

On May 2, 2007, FBI agents confronted Brooks-Simms about the $100,000 she had accepted from Jefferson in return for her support of a $6.9 million contract to purchase "I CAN Learn" algebra software.

Five days later, she "readily admitted" that the payments were bribes and informed investigators of an additional $40,000 she received from Jefferson, according to the motion.

"Her bold honesty and truthfulness convinced the agents and Assistant U.S. Attorneys that Ellenese Brooks-Simms was willing to cooperate in the investigation of this entire matter," Perricone wrote.

According to the motion, Brooks-Simms described in detail "how Mose Jefferson paid her, why he paid her and where he paid her." She was also instrumental in obtaining guilty pleas from two others: her daughter, Stacy Simms, and former School Board contractor Burnell Moliere.

Brooks-Simms' trial appearance was especially grueling because of Jefferson's accusation that he had an affair with her in the 1980s, Perricone wrote, noting that her husband, Melvin Simms, died about two months before she took the stand. While prosecutors called Jefferson's accusation a fabrication, they did not put Brooks-Simms back on the stand to dispute it.

COLUMBIA, SC (WIS) - A candidate for Columbia mayor will not be on the ballot because he's a convicted felon, and he's not happy about it.

Irwin Wilson isn't nearly as well known or well financed as other candidates for Columbia mayor, but that hasn't stopped him from running.

"Most of this city basically resides in my category, so I would be a very good candidate," said Wilson. "Not only that, David faced Goliath."

But David did not have a criminal record. Wilson does.

It shows him being released in December 1997 after serving almost three years in prison for criminal sexual conduct. The release date is important to Municipal Election Commission members.

They moved Friday to disqualify Wilson as a candidate, saying he hasn't met a constitutional requirement that says anyone with a felony conviction has to wait 15 years after the sentence ends to run for office.

The commission did give a green light to another candidate, Antonio Williams, who is making his second attempt at winning a council seat.

Williams' record includes 1990 convictions for burglary and grand larceny.

"In Mr. Williams' case, his sentence expired more than 15 years ago," said Hamilton Osborne with the Election Commission. "And in Mr. Wilson's case, it did not."

Wilson says the 15-year requirement should not apply to him because the law was changed after he went to jail.

"I believe once a law is passed, I believe it shouldn't be retroactive," he said. "I believe it's supposed to be to whomever is arrested after that time and forward. But not for anyone that's already serving a sentence or have served a sentence

In South Africa, the lifestyles and business relationships of Cabinet ministers and prominent politicians of the ruling African National Congress Party are coming under intense scrutiny.

Calls are growing for "lifestyle audits" of public officials to assess their income and spending to help root out corruption.

At a recent, raucous news conference, ANC Youth League spokesman Floyd Shivambu sparred with journalists investigating the group's president, Julius Malema, on conflict of interest charges, conflicting statements about his business interests and his apparently luxuriant lifestyle.

The dozen or so journalists at the news conference have been working on stories about how Malema could afford what has been widely described as his "lavish lifestyle" on his ANC salary, reportedly some $2,500 a month.

Malema, 29, denies any wrongdoing.

Piet Rampedi, an investigative reporter with City Press, is one of the journalists digging into Malema's business ties.

He notes that Malema owns luxurious cars and two houses — one in an exclusive Johannesburg suburb — worth approximately $500,000 and $150,000.

"He has bought all these properties since 2007. And according to official records, those houses were not bonded; they were bought for cash. Common sense would tell you there is no way he would have earned enough to buy those houses," Rampedi says.

Rampedi has been pursuing the Malema story for months. He and other journalists have recently reported Malema's ongoing ties to several companies that benefited through government contracts in Limpopo province worth millions of dollars.

Malema says he told his attorneys to break these business ties once he became president of the ANC Youth League in 2008. But they are still listed in public documents the journalists obtained.

"There was always this big question from almost everybody: Where does this guy get all the money to sustain his luxurious lifestyle?" Rampedi says.

"He has always denied having business links, he has always denied having any business interests, and he has always denied having any interest in any company," he says.

The media, opposition parties and some civil society organizations believe Malema is among some ruling ANC party politicians who have used their political power to enrich themselves and their friends, and ensure that their political allies are rewarded with lucrative business contracts or tenders, while closing the door on others.

During a radio interview as combative as the news conference, host Redi Direko asked Malema about reports that he had used his influence to make money.

"These are all lies. These are just fabrications," Malema responded.

Although so far he has refused to do so, Malema said he could account for the sources of all his money.

"There's nothing I got from this government," he told Direko.

"I've got nothing to do with stealing from the poor. There's nothing wrong I've done," he continued, when Direko brought up the issue of government tenders.

While not naming Malema specifically, the African National Congress' alliance partner, the powerful Congress of South African Trade Unions, has been among the strongest voices calling for lifestyle audits.

Zwelinzima Vavi, secretary general of the Congress of South African Trade Unions, says the offenders are a small minority. Vavi refuses to identify those he suspects of being awarded lucrative contracts. Vavi calls them "tenderpreneurs."

"People are just sick and tired of the stories that have been written in the newspapers of the tenderpreneurs, of the back-stabbers and crass materialists who want to hijack the ANC and make it an instrument and a vehicle to take forward their narrow interest," Vavi says.

But South African President Jacob Zuma, who has faced corruption allegations, has come out against lifestyle audits. And during intense parliamentary debate on the issue, Deputy President Kgalema Motlanthe told parliament that there was no need to go beyond the selective lifestyle audits done by the South African Revenue Service.

But the debate is likely to intensify. A recent report said more than 2,000 government officials were benefiting from government tenders worth more than $26 million.

Default Toni Clark gets six months in jail

Former Milwaukee County Supervisor Toni Clark was sentenced Friday to six months in jail, with work-release privileges, and three years' probation for a felony conviction of filing a false campaign report.
She placed some $6,500 in campaign donations into her personal bank accounts over seven years, though prosecutors were unable to untangle how Clark used the money because her personal and campaign finances were such a mess.
Assistant District Attorney Bruce Landgraf said Clark "suffered something of a personal financial implosion" made worse by her gambling.
Clark, 41, pleaded guilty to the charge and was sentenced at the same hearing, before Reserve Judge Dennis Flynn. She told the judge she was a gambling addict during the entire time she's held office, since 2003. The judge ordered her to continue treatment for her gambling addiction, if her probation agent recommends it.
Flynn acknowledged the positive work Clark had done in office and also as a teacher and youth mentor. But he said her crime was a violation of the public trust and warranted a meaningful penalty. Her conviction was for submitting a false campaign report in 2007, but the complaint against Clark lays out years of improper handling and accounting of campaign cash.
The missing campaign money added up to $6,545. Clark's failure to properly account for her campaign money also sent the wrong message to donors, the judge said.
"One of the inferences that can be drawn is that they are simply paying you off," Flynn said. The complaint filed Thursday, however, did not allege any payoffs.
Jeremy Levinson, Clark's lawyer, said her actions were the result of financial and gambling problems, not "someone who is methodically scheming. . . . This was not driven by greed or a desire to personally enrich herself."
Flynn noted Clark's admitted financial management problems, but he said that didn't excuse her actions. She took campaign money and she "used it for other purposes that made sense to you," Flynn said.
Clark must report to the Milwaukee County Jail on April 5 to begin her jail term, but she was allowed work-release for job search and child care, as well as for an actual job, if she finds one. Clark said she has no children of her own but cares for two children in her home.
She has served on the County Board since July 2003 and has also worked as a teacher at Milwaukee Public Schools. Clark is a Milwaukee native and holds bachelor's and master's degrees in education from the University of Wisconsin-Milwaukee.
The jail term went beyond the recommended probation sentence made by prosecutors. By statute, Clark could have been sentenced to up to 3 ½ years in prison, but Flynn said prison time wasn't necessary to protect the public.
As a felon, Clark is barred from ever running for public office again. She also must pay restitution, in an amount to be determined later.

Mose Jefferson was convicted in 2009 for bribing a former official of the New Orleans school board in an attempt to win contracts for a software program he was selling.

Jefferson still faces additional federal charges in an alleged conspiracy to steal hundreds of thousands of dollars in government grant money earmarked for charitable and education programs.

Thomas, a 13-year City Council veteran who was widely considered a leading candidate to succeed Ray Nagin as New Orleans mayor, pleaded guilty in August 2007 to taking $20,000 in bribes and kickbacks from businessman Stan "Pampy" Barre.

Barre, who was seeking to retain a public parking contract, is serving a five-year stint in federal prison.

Marco McClendon was arrested Tuesday night after his girlfriend called police saying he was choking her.

Police later upgraded the charges to a felony after his girlfriend said she was pregnant.

McClendon and his girlfriend, Khawlah Upton, were together today when News Channel 3 caught up with them.

He says police are using her to target him because he's been vocal against the West Memphis Police Department.

City Councilman Marco McClendon was at Upton's apartment when we found him.

He didn't want to talk at first but later agreed.

"I feel this has come because me and Bob Paudert don't see eye to eye. I think he's worried about me running for mayor and replacing him if I win," said McClendon.

McClendon says the upgraded charges are unfair and Police Chief Bob Paudert and his department are using his girlfriend to get to him, "I have been very vocal with the police department. I always stood up on issues and going to continue to stand up on issues and what's right."

McClendon said he and his girlfriend are fine and just argued.

In fact, just hours after giving police her statement she was in court holding his hand during McClendon's arraignment.

"It really did not surprise us. I've seen it repeatedly in domestic situations," said Capt. Donald Oakes, West Memphis Police.

Oakes says they have video of Upton that shows bruises and he says you can hear the fear in her voice.

Oakes says the city councilman intimidated the woman even saying he was "King of West Memphis."

However, officers say it's the District Attorney and not Upton who has the final say about prosecution.

Oakes said, "If she chooses to support him at that point that's a choice she makes. It doesn't change the fact that on the night of the event, she's a victim."

"During the night of this incident, I never said I was the King of West Memphis," said McClendon.

He added, "I'm 100% innocent. And, I'm going to get out in the public and I'm going to talk to the people. Once I get with my attorneys and they allow me to make a statement dealing with the issues, we're going to do that."

McClendon will be back in court next month to answer the felony charges.

People drove cars all over the grass. I seen unmarked police officers …I seen garbage bags in the back yard," Davis said during a hearing Tuesday.It's alleged that exotic dancer Tamara Greene was assaulted at the party by Kilpatrick's wife, Carlita. A few months later, she was killed in a drive-by shooting.Davis said he was ordered not to talk about the party to anyone -- no matter what.But in 2008, years after the alleged incident, Davis was questioned by the Wayne County Prosecutor's Office.He told prosecutors that he had direct orders to drive to several police precincts near the mansion and meet then-Police Chief Jerry Oliver to pick up documents that were to be shredded. Davis said he believes the shredded documents were run sheets that would have shown which law enforcement agencies responded to a reported fight between Greene and Carlita Kilpatrick.

Davis also filed court documents saying on the first day of Kilpatrick’s term, he witnessed his boss on the executive protection unit arrange what he believed to be an extra-marital affair by the mayor at a local hotel.“When they came back up on the elevator, they took the mayor right into the room with the two females," said Davis in court filings.He told Local 4 he believes the women were prostitutes, brought to the same hotel Kilpatrick’s family was staying at that night, to celebrate the election win.

Davis said he was targeted by the executive unit, which was run by Kilpatrick's close friends Mike Martin and Lorenzo Greg Jones, and afterward, experienced a series of demotions.He said in court Tuesday that in the fall of 2002, after another wild party, he heard the officers in the executive unit targeting him."He said the, 'MF party got out of hand last night.' So then Greg said, using profanity, 'That shouldn't have happened.'So then Mike Martin pointed to me and said, 'I don't trust that MF. Lets go in the office,'" said Davis.Davis never came forward with the information until after speaking with prosecutors in 2008. Shortly after, the 25-year veteran was fired from the force.

During opening statements Monday, city attorneys painted Davis as an opportunist. City Attorney June Adams said Davis only came forward years later when he saw that two police officers were awarded $6.5 million in a whistle-blower lawsuit.Kilpatrick was subsequently charged and convicted of perjury in connection with the testimony give in the whistle-blower's trial.Davis said he never reported the incidents because he was instructed not to and because he was fearful of retaliation.Davis said he's only coming forward with the new information because prosecutors insisted he testify under oath.

He served almost four months in jail, agreed to give up his law license and his political career and repay the city $1 million for settling an employment lawsuit related to his misdeeds.Wayne County Judge David Groner ruled last month that Kilpatrick violated the terms of his initial probation by failing to report assets and turn over tax refunds toward his restitution.Kilpatrick will be sentenced to jail on May 25.A sentence of more than a year would place Kilpatrick not in a county jail but in state prison.Kilpatrick still owes the city hundreds of thousands of dollars."I want to thank all of my supporters for their prayers, hugs, encouraging notes and their financial support," said Kilpatrick. "My family and I truly appreciate all you are doing to support us at this critical time. God bless you all!"After Groner found Kilpatrick guilty, Paul vowed to set up a way for supporters to contribute to Kilpatrick.
