Tamerlan Tsarnaev, one of the suspected bombers behind the Boston Marathon bombing last year, was approached by the FBI because of his extremist views and asked to work as an informant, according to court records filed by Dzhokhar Tsarnaev’s defense team.

Attorneys for the younger Tsarnaev are expected to claim that he was under the influence of the dominating Tamerlan, 26, who was killed during a shootout with police days after the bombing killed three people and injured over 260 others on April 15.

In a 23-page court filing Dzhokhar’s defense team asked the court to force the prosecution to hand over more evidence in the case that would be useful to their argument. Included in the document was the assertion that the FBI, aware of Tamerlan’s radical Islamist views, asked him to work as an informant on certain factions in the Boston region.

The court request said “the FBI made more than one visit to talk with Anzor, Zubeidat [Dzhokhar and Tamerlan’s parents] and Tamerlan, question Tamerlan about his internet searches, and asked him to be an informant, reporting on the Chechen and Muslim community,” as quoted by WBUR Boston.

The defense speculated that Tamerlan may have misinterpreted the intention of the conversations, which may have acted as a “stressor that increased his paranoia and distress.” They specifically note that the interviews should not be interpreted as a motivation for the attack, only that they represent “an important part of the story of Tamerlan’s decline.”

“The underlying data concerning the brothers’ activities, state of mind, and respective trajectories is critical,” attorneys wrote, as quoted by the Boston Globe, adding that evidence “shows Tamerlan to have had a substantially longer and deeper engagement than his younger brother with extremist and violent ideology is mitigating for the light that it sheds on their relative culpability.”

The FBI declined comment to Boston news outlets, but cited a bureau statement issued last year declaring that Tamerlan was not under surveillance and that the “brothers were never sources for the FBI nor did the FBI attempt to recruit them as sources.” Prosecutors told the Globe they have “no evidence that Tamerlan Tsarnaev was solicited by the government to be an informant.”

Dzhokhar Tsarnaev, now 20, is being held in the Ayler detention center, a small federal facility located 40 miles from Boston. The prosecution has portrayed him as an aspiring militant Muslim who was trying to carry out a holy war against the US with help from websites supportive of Al-Qaeda. As mentioned before, the defense has sought to paint him as an impressionable young man under the sway of Tamerlan.

Tsarnaev is facing a 30-count indictment for his alleged role in the bombing. Many of those charges, which include use of a weapon of mass destruction, carry the death penalty.

I think this allegation is already posted somewhere in this thread, however, what's interesting is that the brother of the Mad Michael who chopped up the Woolwich soldier Lee Rigby claims that the British secret services asked him to help turn Mad Michael into doing the same thing. Maybe it's a stock defence phrase.

A federal jury on Monday found a friend of Boston Marathon bombing suspect Dzhokhar Tsarnaev guilty of obstructing the investigation into the 2013 attack.

The jury found Azamat Tazhayakov guilty of obstructing justice and conspiring to obstruct justice, in connection with the removal of a backpack with potential evidence from Tsarnaev’s dorm room after the bombings.

Jurors indicated in a verdict questionnaire that they didn’t believe a separate allegation — involving the removal of a laptop computer from the same dorm room — amounted to obstruction or conspiracy.

Sentencing for Tazhayakov, who could get up to 25 years in prison, is scheduled for October. The verdict came in the first trial related to the April 15, 2013, bombings that killed three people and injured more than 200 others.

Tazhayakov’s mother wept loudly in court when the verdict was read. Tazhayakov spoke briefly to his parents before he was escorted out of the courtroom.

Prosecutors accused Tazhayakov and his roommate, fellow Kazakh national Dias Kadyrbayev, of trying to protect Tsarnaev three days after the bombings by removing a backpack and a laptop from Tsarnaev’s dorm room at the University of Massachusetts Dartmouth, which Tazhayakov also attended.

Prosecutors alleged that Kadyrbayev and Tazhayakov took the laptop to their apartment, and that Kadyrbayev, with Tazhayakov’s knowledge, tossed the backpack in a trash bin. Authorities eventually found the backpack — containing Vaseline, a thumb drive and fireworks — in a landfill.

Kadyrbayev is awaiting trial on the same charges and has pleaded not guilty. Another friend, Robel Phillipos, pleaded not guilty to making false statements. None of Tsarnaev’s friends is accused in the bomb plot itself.

Prosecutors told jurors Tazhayakov knew the identity of the suspected bombers — Tsarnaev and his older brother Tamerlan Tsarnaev — before the public found out, allegedly texting Kadyrbayev, “i think they got his brother,” hours before the public knew their names or their relationship to one another. The friends recognized the Tsarnaev brothers after authorities released video and still photos asking for the public’s helping finding the two men, prosecutors said.

Kadyrbayev told his friends that he believed Dzhokhar Tsarnaev “used the Vaseline ‘to make bombs,’ or words to that effect,” an indictment against him reads.

The government said Tsarnaev texted Kadyrbayev after the bombings and told him he could go to his dorm room and take what he wanted. Kadyrbayev showed that text to Tazhayakov, the government alleged.

Authorities alleged that the friends picked up the backpack and the laptop from Tsarnaev’s dorm room on April 18, 2013, shortly before Tsarnaev was taken into custody.

The FBI interviewed the friends as part of the bombing investigation, and lawyers for Tazhayakov said he did everything he could to help the probe when he spoke with investigators. Based on that information, authorities found Tsarnaev’s backpack in the landfill, his attorneys said.

Daniel Antonino, one of the jurors in Tazhayakov’s case, said the panel found him guilty of obstruction because “the backpack was simply taken and discarded like they were getting rid of evidence.”

The Boston Marathon bombing attacks have not been certified as an “act of terrorism” by the US Treasury, an important point holding up some insurance payments.

In the wake of the 9/11 attacks, Congress passed the Terrorism Risk Insurance Act, which created federally-backed insurance in cases of damage due to terrorism. Some Boston businesses were among those that bought the insurance.

Those purchases became relevant after the Boston Marathon bombings on April 15, 2013. Of the 160 companies located near the marathon’s finish line that submitted insurance claims, just 14 percent had purchased terrorism insurance, Insurance Journal reported.

But as of March 2014, many of those that held terrorism insurance had their claims denied. Why? The Secretary of the Treasury Jack Lew has not certified the attacks as an act of terrorism for these insurance purposes, a requirement under the wording of the Terrorism Risk Insurance Act (TRIA).

“The Secretary has not determined that there has been an ‘act of terrorism’ under the Terrorism Risk Insurance Act,” a Treasury spokesperson emailed on Thursday.

Part of the reason for that ruling has to do with the amount of monetary damage done by the bombing. Under the federal law’s wording, a destructive act cannot be certified as terrorism if insurance losses total less than $5 million in aggregate. As of March, the state’s largest property and casualty insurers had issued $1.9 million in bomb-related insurance claims, The Boston Globe reported, well below the required $5 million amount. In addition, compensation is not paid out unless the aggregate losses total more than $100 million, according to the statute.

Still, the lack of a payoff hasn’t stopped Bostonians from buying the terrorism insurance since the bombings. As Boston-based brokerage firm William Gallagher Associates told Insurance Journal, about 80 percent of small and midsized customers own terrorism coverage, a jump from 50 percent before the marathon bombings.

Since the marathon wasn’t really a workplace, maybe they’ll classify this as a roadside hazard.

Regardless, another contribution by Muslims in America: terrorism insurance.

Shutting the city down under armed martial law and violating the rights of citizens surely cost more than $5M.

Never forget that sometimes Dzhokhar was so broke that more than once he had to smoke some pretty harsh weed for several days straight before he could get back on the primo stuff.

Another line of the defense’s questioning will attempt to single out people who strongly identify with the victims of the bombing, even though they do not know any of them personally (a personal connection would disqualify them automatically). The defense team has argued repeatedly the sense of communal injury in Massachusetts and particularly in Boston is so strong that Tsarnaev cannot get a fair trial here, just as it was once judged impossible for Timothy McVeigh to get a fair trial in Oklahoma. Judge O’Toole and an appeals court have rejected these claims.

My shades are black.

This means that the eighteen jurors who are eventually seated will face the difficult, if not impossible, task of separating their duty of representing the community as jurors from the outrage they may feel as members of a community that was attacked, by proxy, when the bombs went off at the Boston Marathon. The prosecution and, likely, its witnesses will repeatedly stress this sense of collective injury. Tsarnaev is accused of attacking America, and he may believe he did. The government will, in effect, ask the jury over and over again, “Are you with us or against us?”

Or maybe the government will ask the jurors if the Bomb Brothers murdered people.

But to Gessen, as to Lenin, the real question is always: “Who? Whom?”

BOSTON — Dzhokhar Tsarnaev was found guilty Wednesday on all 30 federal counts in the 2013 Boston Marathon bombing case and faces a possible death sentence.

He was convicted of a string of charges, including the deaths of four people and conspiracy to use a weapon of mass destruction. Seventeen of the 30 counts carried a possible death penalty.

The twin bombings on April 15, 2013, killed three people and injured 260. A fourth person, an MIT security officer, was killed during a six-day manhunt for the suspects that brought the stunned city to a standstill.

Tsarnaev, flanked by his three lawyers, showed no emotion while the verdict was read, mostly staring at the defense table and occasionally looking straight ahead. At one point the 21-year-old former college student crossed his arms as federal Judge George O'Toole read the lengthy verdict.

The courtroom was silent as each count came down as "guilty."

Although some bombing victims and families of victims were present in the courtroom, there was no rejoicing nor smiling.

The faces of the jurors, who returned their verdict after two days, were likewise sober, as O'Toole reminded them that "you are still a jury."

O'Toole said the penalty phase, in which the same seven-woman, five-man jury will weigh a possible death penalty for Tsarnaev, could begin "early next week."

As the jury left the courtroom, Denise Richard, mother of Martin, the 8-year-old killed in the bombing, wiped tears from both eyes.

"I don't know what justice is," said Karen Bressard, a bombing survivor when asked for her reaction to the verdict. "I am grateful to have him off the street. I'm grateful to show that everyone in the world that this is not tolerated, this is not how we behave."

The outcome of some kind of guilty verdict was in little doubt after the defense acknowledged that Tsarrnaev had placed a pressure-cooker explosive device in the crowd near the finish line of the annual race on Boston's Boylston Street.

The makeshift explosives killed Krystle Campbell, 29, a restaurant manager; Lingzi Lu, 23, a Chinese exchange students, and Richard. Tsarnaev also was found guilty of the fatal shooting of Massachusetts of Institute of Technology police officer Sean Collier, 26.

The defense had argued that while Tsarrnaev was involved in the bombings, he was manipulated by his older brother, Tamerlan, who was killed during a police shootout as the manhunt unfolded.

None of the four defense witnesses suggested that Tsarnaev, an ethnic Chechen who immigrated from Russia with his parents and brother a decade before the attack, was innocent.

"We are not asking you to go easy on Dzhokhar," defense attorney Judy Clarke said in her closing argument Monday. His actions "deserve to be condemned. And the time is now."

Prosecutors described Tsarnaev, a one-time student at the University of Massachusetts Dartmouth, as a true believer in the cause of radical, violent jihad to avenge what he saw as harm by the United States against Muslims.

"The plan was to make this bombing as memorable as it could possibly be," Assistant U.S. Attorney William Weinreb said.

Prosecutors called 92 witnesses over 15 days, including double amputees and the 8-year-old boy's father. They presented a trove of more than 4,000 hours of surveillance footage that left little doubt about the Tsarnaevs' culpability, not only in the marathon bombings but also in the murder of MIT officer Sean Collier.

Collier's family issued a statement thanking the jury and law enforcement for "seeking justice in this case,' and the city of Boston for its support. They also expressed their care for victims, survivors and their families.

"The strength and bond that everyone has shown during these last two years proves that if these terrorists thought that they would somehow strike fear in the hearts of people, they monumentally failed," the statement said. "We know Sean would be very proud of that."

Judge O'Toole met earlier Wednesday with attorneys for both sides for about 30 minutes to address last minute questions raised by the jurors.

The charges against Tsarnaev — totaling 30 counts — fell into four main categories. Twelve pertained to two pressure-cooker bombs used at the marathon.Three other charges dealt with conspiracy; another three covered the fatal shooting of Collier, an MIT security guard, on April 18, 2013.

The final 12 addressed what happened after Collier's murder, including a carjacking, robbery and use of improvised explosives against Watertown, Mass., police officers.

BOSTON (MyFoxBoston.com) -- The family of the convicted marathon bomber is in America, on your tax dollars, and survivors are outraged after learning the news.

As of Thursday, family members of Dzhokhar Tsarnaev have been staying at the Hampton Inn in Revere under very tight security, just one of the things tax dollars are paying for. FOX25's Sharman Sacchetti investigated how much this trip is costing you.

Sources say these family members are being called as witnesses and not only that, at least three agencies are working around the clock to protect and transport them. This is all part of the defense team's strategy to save Tsarnaev. While it's unclear when their flight started, we know the last part of it came through Amsterdam and landed at Logan Airport and cost nearly $2,500 per person.

The cost to put them up at the Hampton Inn at the government rate: almost $200 per night, per person. And a source says at least three agencies, the FBI, US Marshal's and Revere Police are involved in constant protection.

“I think you're probably talking about $100,000 plus in that neighborhood in terms of security and out of pocket costs associated with travel,” former US attorney Michael Sullivan said.

And that's just for this trip.

Lawyer fees or even what all witnesses during the trial cost is still unclear. One defense witness, Mark Spencer of Arsenal Consulting, charged $375 per hour and billing taxpayers for $150,000.

Governor Charlie Baker said, “It's a federal trial, it's a federal case, the feds ultimately need to make the decisions about this.”

Baker was non-committal about how resources are being used, even state ones.

Sullivan told Sacchetti that while he understands taxpayer outrage, the whole point is to make sure it's done right.

“The court wants to make sure that at the end of the day, the defendant gets a fair trial and would not want to add any potential issues on appeal in the penalty phase, prosecutors finished making their case yesterday,” he said.

Marathon survivor Marc Fucarile reached out to us Friday night, reacting to this news, saying that he's outraged that Tsarnaev's family's expenses are being paid for when "myself and some of the other survivors and our families have to pay for our own parking at court, lunch, and we were told that if the trial was moved out of state, we'd have to pay for our own travel and lodging, there."

The statement went on to say: "Why should our country pay for them when that family committed a violent act against our country? Not to mention, all of the free government services this family previously enjoyed on the backs of the taxpayers including government assistance and a free ride to UMass Dartmouth. In contrast, I was denied housing assistance I sought after the bombings, even though I needed a handicapped accessible apartment, and my wife lost her job as a result of the events."

He ended by saying he feels badly for the taxpayers that have to pay for this after they were so generous to

Pretty obvious these two stooges were framed and were most likely under the impression they were participating in a drill. This whole event has the foul stench of the jew all over it almost as much as Sandy Hook.

The US Department of Justice has issued a photograph of convicted Boston Marathon bomber Dzhokhar Tsarnaev, showing him giving the middle finger to a security camera inside a holding cell on July 10th, 2013.

Prosecutors on Tuesday began their case to sentence Tsarnaev to death, with assistant US attorney Nadine Pellegrini showing the photograph, exhibit 1595, to the jury. The image was taken from surveillance footage at John J Moakley Federal Courthouse in Boston on the day of his first court appearance in 2013.

“This is Dzhokhar Tsarnaev,” Pellegrini said. “Unconcerned, unrepentant and unchanged.”

Tsarnaev, a 21-year-old ethnic Chechen, was found guilty on April 8th of killing three people and injuring 264 at the marathon finish line and fatally shooting a police officer as he and his older brother, Tamerlan, prepared to flee three days later.

The sentencing phase is expected to last about four weeks, after which the same jury that convicted Tsarnaev will decide between the death sentence or life in prison.
