New Lawsuit Reveals Challenges Of Taking ‘Fake News’ Peddlers To Court

Brennan Gilmore hopes so. A counter-protester at the 2017 white nationalist rally in Charlottesville, Va., Gilmore has brought a defamation suit against InfoWars, Gateway Pundit and other right-wing conspiracy-peddling sites that he says smeared his reputation.

The lawsuit comes not long after some of those same sites falsely dismissed the student activists who survived the Parkland school massacre as “crisis actors,” and at a time of broader concern about the growing, destructive influence of fake news.

But the hurdles the suit appears to face speak to the challenges of using the courts to hold fake news purveyors accountable.

In a complaint put together by lawyers at the Georgetown Law School’s Civil Rights Center and filed in federal court Tuesday, Gilmore claims false stories saying he was part of a “deep state” plot to undermine the Trump administration by staging the murder of anti-racist activist Heather Heyer have led to threats to his personal safety and caused potential damage to his career.

Gilmore, a foreign service officer on long-term unpaid leave, became a target after sharing on Twitter a video he’d captured from the rally, showing neo-Nazi James Fields’ car ramming into a crowd, injuring dozens and killing Heyer. In response, a number of far-right sites quickly noted that Gilmore had worked for the State Department and donated to Democratic politicians. They used this to suggest he was part of a conspiracy funded by philanthropist George Soros to effect an anti-Trump coup.

In one example, Infowars’ Alex Jones claimed in a video posted online that he “did research” and “confirmed” that Gilmore was a “high-level CIA” operative and “State Department insider with a long history of involvement in psy-ops.” Jones definitively stated that Gilmore helped orchestrate the chaos at Charlottesville and was paid $320,000 a year by Soros.

Within days, Gilmore was subjected to death threats, doxxing and in-person harassment on the streets of Charlottesville that made him fear for his personal safety, according to the complaint. He claims the enduring consequences of these false stories have “compromised” his career, deterring companies from wanting to work with him while he’s on leave and putting him at risk if he rejoins the foreign service and returns abroad, as he plans to. The result has been emotional distress, he says.

Gilmore told TPM he won’t settle for any amount of money, and wants his case to set a precedent. His goal, he said, is “to try and prevent someone else who is in my shoes to be victim to the same type of predation that Alex Jones and his fellow conspiracy theorists directed to me.”

“They knew what they were saying was false and they made no attempt to verify anything,”Andrew Mendrala, supervising attorney of Georgetown Law’s Civil Rights Clinic, told TPM. “[They were] putting this out there with the intention of smearing him and unleashing their followers to sort of carry that out in real life.”

Beyond defamation, the case aims to hold the creators of false online content responsible for their followers’ responses to that content.

That’s why it may be a heavy lift. Although Gilmore may have suffered real personal trauma, strong constitutional protections for publications that traffic in opinion pose a major challenge, First Amendment experts told TPM.

Not all of the defendants used language as unequivocal as Jones’. Derrick Wilson, a writer for former U.S. congressman Allen West’s website, wrote a story suggesting Charlottesville “was a complete SET-UP” and that it was “fishy” that Gilmore formerly worked for the State Department.

That could shield Wilson from the legal standard for defamation, which explicitly relates to false, damaging factual assertions, experts said. Call it the “a lot of people are saying” defense.

“It’s a tough argument to make,” preeminent first amendment attorney Bruce Johnson told TPM of Gilmore’s suit, calling it “path-breaking in terms of the First Amendment issues presented.”

“I could see the core of a defamation case lurking there,” Johnson, a litigator at Davis Wright Tremaine, told TPM. “And I can understand the plaintiff’s frustration because the prevalence of these fake news organizations has clearly infected our political dialogue.”

But, Johnson added, although people can be held liable for false and defamatory facts, “the courts are very reluctant to police individual opinions.”

Then there are the threats. Though the defendants could reasonably be expected to know that their legions of social media followers would go after Gilmore as a result of their bogus stories, it’s difficult to hold them accountable for the actions of others, according to Eugene Volokh, a First Amendment expert at the University of California at Los Angeles School of Law. Volokh noted that the defendants did not direct their followers to threaten Gilmore.

“Outright solicitation of violence or other kinds of crimes, like vandalism, against a specific identified target is probably unprotected,” Volokh said. But condemning somebody or publishing demeaning hypotheses about them is “generally protected, even when the foreseeable result given the audience is that a fraction of it is going to act improperly or even criminally.”

Many of the defendants in the Charlottesville suit have publicly brushed off the case as a concerted effort to silence conservative voices.

Compare the case to a recent lawsuit targeting the far-right brought by the Southern Poverty Law Center (SPLC). Last year, the civil-rights group sued Andrew Anglin, the founder of neo-Nazi site Daily Stormer, for directing his followers to carry out a months-long, anti-Semitic harassment campaign against a Montana Jewish woman and her family.

The SPLC accuses Anglin of invading Tanya Gersh’s privacy, intentionally inflicting emotional distress, and violating Montana’s Anti-Intimidation Act. First Amendment attorneys told TPM the case is strong, pointing to the over 700 messages the Gershes received on their personal devices at all hours of the night, on Anglin’s orders, including death threats and promptings to commit suicide.

Still, both cases represent a burgeoning effort to provide legal redress for private individuals suffering real-world consequences caused by chronic bad online actors.

As Mendrala, the attorney in the Charlottesville case put it: “They feel there’s some anonymity afforded them [online], combined with some vague notion that the First Amendment protects anything that they say about anyone, and that they can operate with impunity. And that’s not the case.”

“We feel like we’re sort of seeking to hold them accountable in ways that maybe they have not yet been,”
he said.

To say that Paul Nehlen’s congressional campaign has been embroiled in controversy would be like saying the Radical Agenda contains material some listeners may find objectionable. His bid to unseat House Speaker Paul Ryan garnered considerable attention from the beginning, as he was backed by Steve Bannon and running right of Trump.

Then he read Kevin MacDonald’s Culture of Critique. (Catch my interview with Kevin here.)

Once one finds out what Jews are up to, life changes. The world begins to make more sense. A determination to set the world right takes center stage of the person’s identity. Enemies come out of the woodwork. Friends distance themselves.

Winning a popularity contest seems an impossible task under such circumstances. Even Bannon backed away from him. That hasn’t stopped Paul from his bid to unseat the House’s Chief Cuck.

Paul has been absolutely relentless. He has appeared on David Duke’s show, and Fash the Nation. His Twitter exploits are so legendary, that he became the first congressional candidate ever to be permanently banned from the platform.

His #ShallNotCensor legislation would put a stop to that kind of ideological censorship.

But it’s not just the Jews and Big Tech that Paul has taken on. He recently exposed the identity of the ever subversive Ricky Vaughn, real name Douglass Mackey, a character who until very recently had the luxury of hiding behind a pseudonym while he attacked the alt right. (Catch my interview with Ricky here)

I don’t take doxing lightly. In all the years I’ve been in business, taking the payment and shipping information of people I’ve in many cases come to later see as enemies, the only person I’ve ever doxed was the woman who aborted my child and made false reports about me to law enforcement. I have not visited this penalty on a single one of the many people who have trusted me with their information and later become ideological rivals. I am privy to no shortage of secrets, and when controversies are aired about movement figures, I’ve often known about those issues well before they became public.

But Nehlen did not dox Vaughn because he disagrees with his politics. He did it because Vaughn is a dishonest, malicious, subversive figure who intentionally acts against the interests of race and nation. He compares white identity to radical Islam, and without the slightest bit of self awareness, says the alt right is just a bunch of people without healthy relationships. Vaughn is the poster child for treason. He dishonors our veterans, sabotages our efforts, subverts our ideas, divides our movement, and undermines our identity, all while purporting to be our leader. He should not have the protection of a pseudonym while he behaves this way.

Welcome to the realm of men with reputations, Douglass Mackey. Let us see how well you fare when you actually have to risk something for your cause.

And it’s not just Vaughn’s identity that Paul exposed. Ricky is trying to go pro in the political realm, which goes a long way in explaining his subversion of the Alt Right.

Marketing himself as the Smartcheckr Consulting Group, Ricky tried to sell the Nehlen campaign thousands of dollars worth of services ranging from social media management to “extreme opposition research” using “proprietary search and facial recognition technology” and “access unconventional databases”. Interesting that a guy who hides behind a pseudonym wants to make a career out of digging up dirt on others, and tying names to faces.

It also begs the question of what “unconventional databases” Vaughn is claiming to have access to. As previously noted, Vaughn and Weev seem to be in league with one another in their efforts to fracture the Alt Right. Could Weev be professionally offering the same talents that got him locked up? One certainly hopes he will not be abusing his position as the technical mind behind TRS and the Daily Stormer. They have some databases that would certainly be seen as “unconventional” to many, and certainly helpful to a far right candidate like Nehlen, or whoever else might be willing to give Ricky a couple grand.

The alt-right is dying right now. If Weev is confirmed as a jew (I think he is, just too much circumstantial evidence, though I can't ultimately prove it), Anglin and the Daily Stormer also will be dead.

Maybe that's why he keeps posting anime and softcore japanese porn on his gab. Really the mark of a leader...

Adrian Chen, the author of the story, told Newsweek that the infamous troll volunteered the information about his Jewish ancestry during an interview.

And his mother has confirmed it. Alyse Auernheimer told Newsweek that she was saddened that her son had wished death on children. She added that she has been estranged from him for over a decade.

“He doesn’t like us,” she said, adding that her son comes from a “large, mixed-race family” with Native American heritage, and that he most certainly has Jewish lineage “on both sides of his family.”

Among the protesters in the rain outside Greg’s office, I met Anglin’s preschool teacher, Gail Burkholder, who described being shocked when she’d learned that her former student had grown up to be a notorious white nationalist. “Why would I think one of my students would become a Nazi who wants to kill me?” said Burkholder, who is Jewish. She’d spotted Anglin’s name in the news after Dylann Roof murdered nine black people in Charleston, South Carolina. Roof reportedly left comments on The Daily Stormer, and he has become a hero to Anglin’s readers, who honor him with “bowl cut” memes.

Roof wasn’t the only killer who read The Daily Stormer. In 2016, Thomas Mair shot and stabbed a British member of Parliament. This year, James Harris Jackson was charged with killing a black man with a sword in New York City and cited The Daily Stormer as an ideological influence. Devon Arthurs, an 18-year-old former neo-Nazi who converted to Islam, shot and killed two of his three roommates in Tampa, who were still neo-Nazis. Police arrested the surviving roommate for hoarding explosive materials.

…He also got deeply into drugs, according to half a dozen people who knew him at the time. He did LSD at school or while wandering through the scenic Highbanks Metro Park, north of the city. He took ketamine, ate psychedelic mushrooms, and snorted cocaine on weekends. He chugged Robitussin, and “robo tripped” so much that he damaged his stomach and would vomit into trash cans at school.

But people who knew Anglin in high school told me that, for reasons that were unclear, his behavior became erratic and frightening sometime around the beginning of his sophomore year at Linworth. Visitors to his house saw holes in his bedroom walls, and they knew that when he was upset, he would smash his head into things. Several recall an episode at a party: Anglin burst out crying after Alison drunkenly kissed someone else, then ran outside and bashed his head on the sidewalk over and over.

He harmed himself in other ways, too. He tried to tattoo the name of his favorite band, Modest Mouse, on his upper arm but gave up after two and a half letters, leaving him with moi etched on his skin. He stretched his earlobes by jamming thick marker caps into piercing holes until they dripped blood. He claimed to feel no pain and used lighters to melt the flesh on the inside of his forearms. He provoked people into assaulting him but never fought back, instead laughing as the blows fell. Two kids beat him into a gutter once. Anglin just lay there until they stopped, out of pity and confusion.

Former friends recall that Anglin’s parents seemed blind to their son’s alarming behavior. And while he could be tender toward his younger siblings, Chelsey and Mitch, and loyal to his friends, he also had a sadistic side. Alison (who asked that her last name be withheld from this article) told me that during Anglin’s sophomore year, she called him, distraught: She said she’d passed out at a party and been raped by a friend’s older brother. She needed compassion and support, but Anglin just laughed and broke up with her.

“You’re a slut,” she remembers him saying.

Several girls Anglin had gotten to know at another high school began calling her house at all hours of the night, according to Alison and other sources. “You deserved it,” they’d say. “You slut.” Alison says the abuse went on for weeks, as Anglin showed friends a video he’d made of them having sex.

After the breakup, Dan Newman, another friend at the time, remembers Anglin once bashing his head into the walls of his bedroom in such a frenzy that his mother had to call the police. Several classmates told me that Anglin didn’t date again in high school and sometimes tried to kiss other boys, including one black student he especially liked. Whether this behavior was authentic experimentation or just for shock value, it’s notable in light of the extreme homophobia Anglin has since expressed on The Daily Stormer and elsewhere. He has advocated, for instance, throwing gays off buildings, isis-style.

By Anglin’s junior year, Greg and Katie’s marriage had come undone. People who knew Katie back then described her to me as a browbeaten woman who lived in fear of her husband. A person who was close to one of Greg’s former clients, along with two Columbus pastors familiar with Greg’s work as a counselor, told me that Greg got involved emotionally, and sometimes sexually, with his female clients. Court documents related to his divorce support this claim: A former client is identified as his girlfriend. Greg would later make her a partner in his counseling practice.

In Davao, however, Anglin hit on every pretty young Filipina he saw and had success with many of them, sometimes taking advantage of their hope that an American husband could be an exit from poverty. Most of these girls were 18 or 19 years old, but Edward says some were younger. He remembers Anglin once picking up a 14-year-old in a bar and bringing her back to the Sampaguita to spend the night…

This fixation on strength is common among members of the alt-right, but Anglin took his devotion to power to a wild extreme. “He thinks in terms of a fascist Disney film,” a prominent white nationalist who has collaborated with Anglin told me, adding that Anglin believed that if he tried hard enough, disciples would flock to his cultish vision and help him summon another Hitler into existence. “He imagines he has some magical power.” Over his heart, he’d tattooed the spidery black sun of the Sonnenrad, an occult symbol in a mystical strain of neo-Nazism whose followers embrace such notions as Hitler being an avatar of Vishnu.

In March 2013, Anglin, or perhaps his father, used Greg’s email address to register the domain name for The Daily Stormer. Then Anglin left the country again. First he went to Greece, where he stayed in a hostel in Athens for three months. He found work giving tours of the Parthenon and other sites and attended meetings of Golden Dawn, Greece’s ultranationalist far-right political party.

On July 4, 2013, The Daily Stormer launched in beta mode, replacing Total Fascism. Anglin named his new site after Der Stürmer, a virulently anti-Semitic Nazi-era weekly that Hitler had read devoutly. (As Anglin would later write, the official policy of his site was: “Jews should be exterminated.”) The Daily Stormer was unlike anything else in white nationalism: The design was clean, the posts were infused with Anglin’s wry humor. It was Nazi Gawker, and it caught on.

…In 2014, Anglin was living in Europe when he found a partner in Andrew Auernheimer, a.k.a. “weev,” a neo-Nazi hacker and troll. Auernheimer grew up in the Ozarks and went to federal prison in 2013 on identity-theft and hacking charges. After his conviction was vacated on appeal a year later, he moved abroad. He now lives in Transnistria, a small, Russia-backed breakaway region on Moldova’s eastern border.

alt-right is just a word, not very meaningful. more people than ever see what's going on. that's the first step. i dont know how anglin can reconcile doxing-as-ultimate-betrayal with working with weev, who is famous for it. but DS has good writers - as long as they produce material daily, they will have readers. the problem is that just reading something isnt the same as doing something in the real world.

they can form these groups and do legal activity, but as 'the game' stands, these groups will be infiltrated and people doxed. unless they have some new techniques or new vetting.

I've now listened to the whole show and yeah...I found the the theory of his pretty plausible. Everything falls into place in light of it. The optics obsession makes a whole lot more sense in that case.

'Weev' is basically an agent that represents something bigger than just himself, if true.

So now two WN groups have inexplicably taken deals. Jason Kessler was offered a deal by CharlottesvilleSSR but refused. Only one insignificant leftist group, Redneck Revolt, was a target of this lawsuit that seems bent on disarming everyone coming to UtR2. I have not seen anything that targets the antifa, BLM or random leftists.

On one hand, I ask Dr. Heidi Beirich to sit down with my elderly folks AFTER they have been upset by the Willy's gang trying to hunt me down by contacting them, some here have condemned, convicted and called me all kinds of names, yet on the other hand, some of you are handing out unlimited free passes to Will Williams, David Pringle, Jay Hess, Christopher Cantwell, and several others, all tied into the organizing and planning of the Charlottesville fiasco.

I mentioned Cantwell's connections to Willy's gang weeks ago. Over the past couple of days I have posted new DETAILED information on Will Williams and David Pringle's contact with the feds and SPLC.
