EU Lawmakers Back Plans for 40 Percent Quota for Women on Boards

European Union companies may soon be forced to favor women over equally-qualified men for supervisory board seats after EU lawmakers backed draft rules that would impose a 40 percent quota for female directors.

The European Parliament in Strasbourg, France, today voted with 459 votes in favor of the draft law, 148 votes against and 81 abstentions. To become law, the plans still need the backing of EU members states.

The European Commission, the EU’s executive authority, proposed the new law last year to make boards two-fifths female by 2020. EU Justice Commissioner Viviane Reding called today’s vote a “historic moment for gender equality.”

In 2013, 17.6 percent of non-executive board members of the EU’s largest companies were women, according to the commission. The European Parliament’s push for more female candidates in top posts almost scuppered the appointment of Luxembourg’s Yves Mersch to the European Central Bank’s Executive Board last year. Bundesbank President Jens Weidmann earlier this year said he won’t set a quota to promote women into management in the German central bank.

The measures would apply to about 5,000 listed companies in the EU by 2020 and state-owned companies by 2018, the commission said last year. They exclude companies with less than 250 employees or global sales below 50 million euros ($67.6 million).

Skopje. Macedonia should start the EU accession talks without any delay since not only Brussels’ authority is set at risk but also UN’s, as latter’s negotiations process brings no results. This is said in the draft resolution of the European Parliament (EP), worked out by European Parliament’s rapporteur on Macedonia, Richard Howitt, Macedonian online news edition MKD.
The draft resolution was presented before the Committee on Foreign Affairs. None of the Greek MEPs made a statement during the debate, while the Bulgarians, on the other hand, continued their anti-Macedonian tirade, MKD comments further.
“I said two major things, which were also backed by shadow rapporteur for Macedonia, Dr. Eduard Kukan – we do not want backward development. Everyone is aware that last year’s events were a challenge for the country,” Howitt remarked.
“Bulgarian MEP Evgeni Kirilov fist said that the reaction of the Macedonian government was always one and the same for all reports – that the name issue is the only problem before Macedonia’s European integration and that it cannot be blamed for anything. He said that there was a need of more criticism because Skopje is conducting a nationalist policy. President of the EU Council Herman Van Rompuy and European Commission President Jose Manuel Barroso made similar remarks.

Only Van Rompuy indirectly hinted at the situation with Ukraine, saying that the EU respected the sovereignty of its neighbors and was not applying any pressure.

BELGRADE – Bulgaria backs Serbia along the path toward the EU, and the exchange of experiences concerning security and other aspects of EU accession is very important in that process, Serbian Defense Minister Nebojsa Rodic and Bulgarian Ambassador to Serbia Angel Dimitrov agreed on Tuesday.



In recent years, bilateral cooperation in the field of defense is at the highest level which has been confirmed by the joint military exercise at the Shabla training grounds in Bulgaria, and the training of Bulgarian pilots at the airport in Batajnica, the Ministry of Defense said in a release.

The Bulgarian Ministry of Defense granted Serbia the right to use the Bulgarian codification software BULCOD free of charge, the release noted.

“It is evident that the plans for bilateral military cooperation have been realized to a great extent, which is a result of good planning and well-defined priorities,” the release adds.

The two defense ministers are due to meet in February, 2014.

The neighborly relations and joint interests on a wider plane are certainly the basis for planning next activities, Rodic and Dmitrov said, concluding that the plan for military cooperation in 2014 should be good, but realistic, taking into account the budgetary constraints.

Serbia, Albania and (FYR) Macedonia are hoping in the coming eight days to receive the approval of European Union member states for the start of formal talks on membership of the EU.
(FYR) Macedonia's hopes of a green light to accession talks at the European Council next Thursday and Friday (19-20 December) are, however, certain to be dashed once again by opposition from Greece, as the latest efforts to resolve the problem at the root of Greece's opposition have foundered. Greece wants (FYR) Macedonia to change its name, arguing that it implies a territorial claim to its province of the same name. Macedonia has been a candidate for EU membership since 2005.
Backing for Serbia's bid appears assured, as EU leaders stated clearly in June that they see the start of membership talks as an essential means of consolidating a breakthrough achieved in April, when Serbia and Kosovo reached a broad agreement on autonomy for Kosovo's Serbs. Belgrade will nonetheless feel some disappointment, as it had hoped to start formal talks with the EU before next week's summit. The launch of negotiations, which requires an inter-governmental conference, has been conditional on Serbia and Kosovo settling many details not addressed in April's agreement. The main obstacle now, though, is seen as Germany's parliamentary procedures, rather than at the political level. Germany has repeatedly indicated since June that January was the more realistic start date.

Parliament calls for EU roadmap to protect fundamental rights of LGBTI people

The EU should draw up a roadmap to protect the fundamental rights of lesbian, gay, bisexual, transgender and intersex (LGBTI) people, says a resolution adopted by Parliament on Tuesday. In the 2013 EU LGBT survey, the EU Fundamental Rights Agency found that 47% of LGBT people felt discriminated against or harassed and 26% were physically attacked or threatened with violence in the previous five years.

"Homophobia must not be tolerated in Europe any more. So many of us lesbian, gay, bisexual, transgender and intersex people have lived our lives in fear for too long. Fear of holding hands on the street, fear of being called names, fear of being thrown out of our houses, schools or jobs. My report says the EU must act on this, so that we, too, may enjoy the rights guaranteed to all in the EU", said rapporteur Ulrike Lunacek (Greens/EFA, AT).

Parliament’s resolution, passed by 394 votes to 176, with 72 abstentions, strongly regrets that the fundamental rights of LGBTI people are not always fully upheld in the EU. It calls on the European Commission, EU member states and EU agencies to work jointly on a roadmap to protect their fundamental rights, similar to existing EU strategies against discrimination based on sex, disability or ethnicity.

MEPs put forward several themes and objectives that should be addressed in the EU roadmap, in areas such as employment, education, health, goods and services, families and freedom of movement, freedom of expression, hate crime, asylum, foreign relations etc. The resolution clearly states that this comprehensive policy must respect member states' competences.

Hate crime

The current EU framework decision on combating certain forms and expressions of racism and xenophobia by means of criminal law should be revised to include bias crime and incitement to hatred on grounds of sexual orientation and gender identity, MEPs say.

Families and free movement

The Commission should produce guidelines to ensure that the directives on the right of EU citizens and their family members to move and reside freely within the territory of the member states and on the right to family reunification "are implemented so as to ensure respect for all forms of families legally recognised under member states' national laws".

Anti-bullying policies

In the field of education, the Commission should promote equality and non-discrimination on grounds of sexual orientation and gender identity throughout its youth and education programmes, says the text. It should also facilitate the sharing of good practice in formal education among member states, including teaching materials, anti-bullying and anti-discrimination policies, in a non-binding way.

Transgender persons

MEPs say that member states should "introduce or review legal gender recognition procedures so they fully respect transgender people's right to dignity and bodily integrity", e.g. to preclude any requirement for them to undergo sterilization. They add that the Commission should continue to work with the World Health Organization to stop considering transgender individuals mentally ill.

BRUSSELS -- Three current and future EU presiding countries say they will "work on the further progress of negotiations on the membership of the Western Balkan countries."



Italy, Latvia, and Luxembourg will hold the presidency of the EU over the next year and a half, and in a joint program, they stressed that "the policy of enlargement is of strategic importance, as the fundamental means of improving peace, democracy and security in Europe."

The program and the strategic guidelines framework for the EU's activities until the end of 2015, reiterates that after the start of the membership negotiations with Serbia in January 2014, and on the basis of the outcome of the screening, the negotiations will continue in accordance with the new approach, so that their true progress is secured, the Beta news agency reported.

The agency said it had seen the program, which sets the condition for Serbia "to be capable of honoring the requirements laid out in the negotiating framework and for it to satisfy the negotiations' criteria."

It was also reiterated that special attention will be dedicated to the European prospects of the Western Balkans, and that each candidate country will be graded according to their accomplishments in carrying out the necessary economic and political reforms.

According to the documents, the Council of Ministers of the EU will continue to support the EU perspective of Bosnia-Herzegovina with the goal of arriving to the status of candidate for membership, "respecting the principle of equal and strict conditions."

It added that "membership negotiations could be launched with the Former Yugoslav Republic of Macedonia based on the decision of the Council of Ministers and with the approval of the EU Council," and without delving into the "name dispute" between Athens and Skopje, stressed once again that it was the condition for determining a date for the start of negotiations with Skopje.

The tripartite document also noted that after Albania was made a candidate for membership, the start of negotiations would depend on "the further progress of reforms" in that country.

European leaders in Brussels have nominated Jean-Claude Juncker, the former prime minister of Luxembourg, to be the next president of the European Commission, the powerful bureaucratic arm of the European Union.

Juncker, a European federalist, is well known for his commitment to further expanding the power of the European Union. His nomination—expected to be easily approved by the European Parliament on July 16—sends a clear signal that the European establishment has no intention of slowing the relentless march towards a United States of Europe, despite the surge of anti-EU sentiment across Europe.

British Prime Minister David Cameron and Hungarian Prime Minister Viktor Orban were the only two leaders of the 28-member bloc to vote against Juncker during a special meeting held in Brussels on June 27.

Cameron said he was opposed not only to Juncker as a candidate, but also to the way in which his candidacy was put forward.

Previously, the president of the European Commission was selected by European leaders on the basis of consensus.

But in what many see as a power grab aimed at downgrading the influence of national governments within the EU, new rules—based on an expansive interpretation of the Lisbon Treaty (aka the European Constitution)—state that the party winning the most votes in elections for European Parliament puts forth its preferred candidate. National governments are then obliged to "nominate" the candidate, after which the individual is formally approved by the European Parliament.

Juncker was the "lead candidate" (Spitzenkandidat) of the center-right European People's Party (EPP), which won the European Parliament elections that ended on May 25. He therefore has a "popular mandate" to lead the European Commission, according to Juncker and his supporters.

Proponents of the new Spitzenkandidat system say it enhances the democratic legitimacy of the unelected European Commission. Rather than EU governments picking a candidate behind closed doors, the individual is appointed by the European Parliament, which supposedly speaks for the people.

Critics rebut that the new system amounts to an "institutional coup" because it severs any remaining direct connection with the democratic process at the national level. At least under the old system, they say, the leaders who chose the Commission president were in some way accountable to their national electorates.

Juncker's so-called popular mandate is also undermined by an analysis carried out by Open Europe, a think tank campaigning for EU reform. The analysis notes that out of a total electorate of approximately 395 million people, 40.3 million (10.2%) voted for EPP affiliated parties during the most recent election. However, this number falls to 38.4 million (9.7%) when excluding Hungary and Sweden, two countries that refused to endorse the new system.

"In reality," writes Open Europe, "far less than 9.7% can be said to have genuinely voted 'for Juncker' given that the majority (outside of his native Luxembourg) did not know that he was standing—or even who he was."

In any event, German Chancellor Angela Merkel successfully pushed for Juncker, presumably out of fear that choosing an alternative candidate—after paying lip service to the need for democratic legitimacy within the EU—would provoke even more resentment of the European project.

Cameron said the selection of Juncker was "a bad day for Europe" because it deliberately ignored the "pro-reform message" sent by European voters in May. Cameron added that "this whole process has simply reinforced my conviction that Europe needs to change."

That sentiment was almost certainly reinforced on July 1, when Members of the European Parliament elected Martin Schulz, a German Socialist, for a second term as president of the European Parliament.

As part of a backroom deal to ensure that Schulz—who has long been suspected of political cronyism—would support Juncker as Commission president, Schulz was offered a pay and perks package worth over €265,000 ($365,000), more than half of which will be exempt from income tax.

"The re-election of Schulz via a secret ballot following a backroom stitch-up between the main center-right and center-left blocks epitomizes the EU's democratic flaws and exposes the hollow nature of the arguments in favor of spitzenkandidaten," Pawel Swidlicki, a research analyst at Open Europe, said in an interview with the Daily Telegraph.

"Schulz is an aggressive proponent of increasing the power of the European Parliament and so will be a big obstacle to EU reform."

Indeed, Schulz can be expected to join forces with Juncker to prevent anti-EU parties from achieving any meaningful reforms to the European Union.

Juncker, a 59-year-old veteran of EU deal-making, has been an unabashed advocate for expanding the powers of the EU. Like Schulz, he will be unlikely to favor transferring any powers from Brussels back to EU member states. Nor has Juncker ever been an advocate for more democratic accountability within the EU.

Commenting on the introduction of the European single currency in 1999, Juncker said: "We decide on something, leave it lying around and wait and see what happens. If no one kicks up a fuss, because most people don't understand what has been decided, we continue step by step until there is no turning back."

Referring to the European Constitution in 2003, Juncker said: "The Convention has been touted as the great democracy-show. I have not seen a darker darkroom than the Convention."

Commenting on the 2005 French referendum on the Lisbon Treaty, Juncker said: "If it's a Yes, we will say 'on we go,' and if it's a No we will say 'we continue.'" He also said: "Those countries that vote No must vote again... to obtain the right answer."

Referring to the popular opposition to the Lisbon Treaty in 2007, Juncker said: "I am astonished at those who are afraid of the people: one can always explain that what is in the interest of Europe is in the interests of our countries." He added: "Britain is different. Of course there will be transfers of sovereignty. But would I be intelligent to draw the attention of public opinion to this fact?"

Commenting on EU monetary policy in 2011, Juncker said: "Monetary policy is a serious issue. Juncker's appointment as the supreme Eurocrat makes it all but certain that the European Union will seek to centralize even more power in the hands of an unaccountable elite.

Why big time tax dodgers love Mr Juncker

SUPPORTERS of would-be European Commission president Jean-Claude Juncker should perhaps pause to examine the great man’s record of wreaking fiscal havoc across the continent. Thanks to Luxembourg’s warm embrace of corporate tax dodgers under his watch, those same austerity-hit EU governments who are backing his appointment have been denied huge sums in tax revenue over the years.
Juncker was prime minister of Luxembourg from 1995 until the end of last year, as well as its finance minister for 20 years until 2009. But in the Grand Duchy (population: 525,000) these roles weren’t enough for Juncker. In the early 1990s, as chair of the European Union’s council of economic and financial affairs, he played a key role shaping the economic and monetary aspects of the 1992 Maastricht Treaty, and in 2005 became president of the Eurogroup of finance ministers within the euro area.

Tax-free flows of money
Luxembourg under Juncker certainly exploited the economic freedoms enshrined by the EU’s founding treaty and assiduously promoted by Brussels’s big cheeses. Over the 20th century’s closing decades it would turn itself into little more than a tax haven – but, crucially, one at the heart of Europe entitled to tax-free flows of money in and out of its borders in a way traditional sunny island havens such as the Caymans could only dream of. The Grand Duchy became the member of the economic club that pilfered from the club’s funds.

An especially fruitful line has been multi-billion-pound corporate tax avoidance at its neighbours’ expense. In the most infamous case, Vodafone still routes more than £50bn worth of loans through Luxembourg for no purpose other than taking advantage of tax laws and administrative rulings carefully tailored by Juncker’s governments to facilitate large-scale tax avoidance. As the last Eye reported, the company is sitting on a £17.4bn “tax asset”, ie reduction in future tax bills around the world, courtesy of Här Juncker. Funnily enough, the company’s largest tax dodge is in the country on whose leader’s support he depends for his Brussels elevation: Germany.

Transparency initiatives
As Eye 1314 reported two years ago, hundreds of other multinationals, including the UK’s Glaxo, Tesco and Financial Times publisher Pearson, use Luxembourg in similar ways at enormous cost to Europe’s economies.

The European Commission has never taken serious action against this tax dodging, however – unlike the use of undeclared accounts by tax evaders against which it has tried, with mixed success, to act – but with no thanks to Juncker’s Luxembourg. The Grand Duchy has resisted transparency initiatives at every step and has only just been persuaded to sign up to a new EU “savings directive” aimed at informing tax authorities of hidden accounts.

When Juncker announced he would relent last year, after looking at Switzerland and noticing what an angry US can do to small countries that hide its citizens’ dirty money, he admitted it was only “because the Americans leave us no other choice”.

Tax dodging isn’t Luxembourg’s sole selling point. Despite experiences such as the collapse of the fraudulent Luxembourg-registered bank BCCI in 1991, Juncker pursued an aggressive regime of financial deregulation, especially in the area of investment fund administration. So it was no surprise that when Bernard Madoff’s ponzi scheme collapsed in 2008, a large chunk of the money had come through loosely regulated Luxembourg funds set up by Swiss banks.

With economic credentials like these, who could argue with Juncker’s appointment as supreme Eurocrat?

Merkel seeks to strengthen EU ties to Western Balkans

German Chancellor Angela Merkel plans on working closely with Western Balkan countries to bring them closer to the EU, a process she initiated by hosting a high profile Western Balkan Conference in Berlin on Thursday (28 August). EurActiv Germany reports.

All seven successor states of the former Yugoslavia, as well as Albania, have a "European perspective", German Chancellor Angela Merkel said on Thursday (28 August) at the much-anticipated Western Balkan Conference that ended with optimism for the region's EU integration.

"All states in the Western Balkans should have the opportunity to join the European Union if they fulfill the accession requirements," Merkel emphasised.

The Chancellor spoke in the Federal Chancellery during a joint press conference with European Commission President José Manuel Barroso and Albanian Prime Minister Edi Rama. Rama also serves as chief of the South-East Europe Cooperation Process (SEECP).

Before the start of the Western Balkan Conference, Barroso had a one-hour meeting with Merkel, where the two exchanged views on the upcoming EU special summit and the developments in Ukraine.

Government leaders, EU representatives and economic and foreign ministers from Western Balkan states, Slovenia and Croatia participated in the Berlin event. The conference was a continuation of the so-called Brdo Summit in Dubrovnik, Croatia, which Merkel attended in July. The goal of the Berlin conference, initiated by Chancellor Merkel, was to strengthen cooperation between the regions and explore the states' perspectives for EU accession.

At the press conference, Barroso outlined the shared interests between the EU and the Western Balkan region. "Our common goal is clear: We want to see the Western Balkan countries ultimately join the European Union. This is in our joint political, economic and geo-strategic interest. This is the right way to defend the long term prosperity of all the citizens in our European family and also to defend European stability," he said.

He emphasised that further EU accessions, "depend on our partners' own speed of reforms. But they will happen over time. We don't want to leave any doubt about it".

All participating countries hope the accession process will move forward quickly, Merkel said. But it is up to the individual countries, the Chancellor pointed out, to fulfill the high expectations of their populations.

Most of all, the people hope for "economic advancement and measures tackling unemployment", she said.

The process initiated in Berlin is expected to continue and be converted into a longer working process. The next host is expected to be Austria in 2015.
